Statybų valstybinio valdymo efektyvumas teisėkūros atvirumo ir skaidrumo principų kontekste

LTStraipsnyje, remiantis teisės aktų analize, siekiama atskleisti statybų valstybinio valdymo teisinio reglamentavimo efektyvumą teisėkūros atvirumo ir skaidrumo principų kontekste. Tuo tikslu straipsnyje aptariama statybos proceso valstybinio valdymo samprata, nagrinėjamas statybos leidimo išdavimo ir statybos užbaigimo procedūrų teisinio reglamentavimo efektyvumas. Straipsnyje laikomasi nuomonės, kad statybos sektoriaus veiklos efektyvumą ir skaidrumą didele dalimi lemia įstatymo leidėjo formuojamas statybos proceso teisinio reguliavimo tikslas, idėja, problemos suvokimas, žinojimas, ar planuojamas reguliavimas tarnaus viešajam interesui ar tik atskiroms grupėms. Tyrimo metu nustatyta, jog sukurtos statybą leidžiančių dokumentų išdavimo ir jos užbaigimą patvirtinančios procedūros bei atliekama statybos valstybinė priežiūra ne visada užtikrina statybos proceso skaidrumą, teisėtumą, ko pasėkoje, statybas pripažinus neteisėtomis, žalą patiria visuomenė, aplinka ir valstybė, nes neužtikrinama jų interesų apsauga. ENBased on the analysis of legal acts, the article seeks to reveal the effectiveness of public management of construction in the context of the principles of legislative openness and transparency. To this end, the article discusses the concept of public management of the construction process, examines the effectiveness of legal regulation of construction permit issuance and construction completion procedures. The article is of the opinion that the efficiency and transparency of the construction sector activities are largely determined by the way legislator forms the goal and idea of the legal regulation of the construction process, as well as by perception of the problem, knowledge of whether the planned regulation will serve the public interest or only individual groups. These objectives can be achieved by creating a legal framework for the construction sector in strict compliance with the principles of legislation, which express the imperative requirements for legal entities. The investigation revealed that the established procedures for issuing construction permits and construction completion, as well as public supervision of construction, do not always ensure the transparency and legitimacy of the construction process, as a result of which, once construction is declared illegal, society, the environment and the state suffer as their interests are not protected.
