Vaiko teisių įgyvendinimo aspektai Lietuvoje po 2018 m. liepos 1 d. teisinio reguliavimo pakeitimo
LTStraipsnyje analizuojami vaiko teisių užtikrinimo įgyvendinimo aspektai Lietuvoje, pateikiant reformuoto Vaiko teisių apsaugos pagrindų įstatymo ir vaiko teisių apsaugos mechanizmo spragas. Daroma išvada, jog įsigaliojus naujai įstatymo redakcijai, visapusiškai vaiko teisės ir teisėti interesai nėra užtikrinami. Straipsnyje pateikiami vaiko teisių apsaugos pagrindų įstatymo naujos redakcijos pokyčiai, vaiko atskyrimo nuo tėvų procesiniai etapai, jo esmė bei procesas. Išryškinama, kokią įtaką daro intervencijos naudojimas prieš šeimą vaiko teisių apsaugai. Atsižvelgiant į tai, jog vaiko paėmimas iš šeimos šiuo metu yra viena iš aktualiausių teismų jurisprudencijoje nagrinėjamų klausimų, todėl straipsnyje didesnį dėmesį sutelkiama į šio proceso vykdymo reguliuojančių normų svarbą, kurios numatytos Jungtinių Tautų vaiko teisių konvencijoje bei, kaip minėta, naujos redakcijos Lietuvos Respublikos Vaiko teisių apsaugos pagrindų įstatyme. ENThe article analyzes the aspects of the implementation of children rights in Lithuania by presenting the gaps in the reformed Law on the Protection of Children rights and the Mechanism of the Protection of the Children rights. It is concluded that after the new wording of the law, the rights and legitimate interests of the child are not fully guaranteed. The article compares the changes in the new version of the Law on the Protection of the Children Rights, the procedural stages of the separation of the child from the parents, its essence and processes. The impact of the use of interventions against the family on the protection of children rights is highlighted. Considering the fact that the child's separation from the family is currently one of the most relevant issues in the jurisprudence of the courts, the article focuses more on the importance of the norms regulating the execution of this process, as provided in the United Nations Convention on the Children rights and, as mentioned above, the new wording of the Children Fundamental Rights.
