ENThis study is an attempt to analyse the institutional aspects of the development of the human rights protection in the EU. While analysing the development of the human rights protection from the Stauder case to the Treaty of Lisbon, it has been generally focused on the relationship between the EU law and the European Convention on Human Rights (hereinafter referred to as the ECHR). Moreover, a particular emphasis has been placed to the practice of the European Court of Human Rights (the Strasbourg Court), which best reflects the attitude of the Strasbourg Court towards the relationship between the EU law and the ECHR. This emphasis is important, in the authors' point of view, while evaluating the issue of the accession of the EU to the ECHR. Controversial aspects of the EU accession to the ECHR are being discussed in the last section of this study, where the evaluation of necessity of the accession of the EU to the ECHR is stressed and the analysis of the most disputable legal issues concerning the accession is conducted.
