LTPasirinktas teikiamos skaitytojams vertinti monografijos tyrimo objektas - civiliniai autorių teisių gynimo būdai teisės doktrinos požiūriu yra visiškai naujas, pirmasis mėginimas panagrinėti ypač probleminę Lietuvos teisės doktrinos privačios teisės sritį. Taigi tai unikali galimybė išanalizuoti autorių teisių gynimo problematiką ir specifiką, tačiau, kita vertus, ir itin sudėtingas uždavinys, nes knygoje pateikiamos išvados apie tiek kai kurių teisių gynimo būdų taikymo sąlygas ir ypatumus, tiek apie esamų problemų sprendimą lemia monografijos autoriaus didelę atsakomybę: kaip šios išvados bus priimtos ir vertinamos tiek teisės moksle, tiek praktikoje. Reikia tikėtis, kad ši knyga bus naudinga ne tik teisės mokslui, bet ir praktikai: tiek autoriams, kurie gali naudotis įstatymuose numatytais savo teisių gynimo būdais, tiek teismams, ginantiems autorių teises, nes nuo to, ar tinkamai taikomi teisių gynimo būdai, priklauso veiksmingas šių teisių įgyvendinimas. ENFollowing the restoration of independence in Lithuania, the private ownership, freedom to express thoughts and ideas, as well as to develop creative works and business activities were restored to the state life, which stipulated the enhancement of protection and enforcement of copyright. The twelve years of independence saw the adoption of a new Lithuanian law regulating copyright, which was harmonised with the international treaties and the basic provisions of the legal acts of the European Union, not to mention the accession to the major international treaties on copyright. Notwithstanding the fact that the possibilities of protection of copyright are provided by laws, in practice, however, the enforcement of copyright is still inadequate. One of the most significant assumptions laid on the development of culture, arts, science, literature, economics and the respect of human rights centres not only on statutory rights vested in the authors but it should also focus on the protection of the said rights, as well as on the creation of conditions for each person, whose rights are being infringed, to have opportunity to effectively safeguard his rights. The enhancement of the protection of copyright is stipulated by the increasing significance of such rights and the other objects of intellectual property in economics and cultural industry, as well as by their utmost vulnerability, which results in the necessity to be protected in an effective and efficient manner. Failure to apply statutory remedies in proper or adequate manner, as well as the existing gaps in the laws impeding the efficient protection of copyright, or ignorance of the exercise of the remedies, result in ineffective enforcement of copyright in practice. The foregoing reasons have predetermined the analysis of this subject. Therefore, the main attention in this thesis is focused on the study of statutory remedies of copyright.The subject matter of the thesis comprises a study of civil remedies of copyright and application thereof. Civil remedies of copyright are being analysed herein in accordance with the Law on Copyright and Related Rights of the Republic of Lithuania of 18 May 1999 and the Civil Code of the Republic of Lithuania of 18 July 2000, as effective at the time of this thesis. This work deals briefly with the remedies of copyright which are not stipulated in the Lithuanian legislation, however the application whereof exists in the states referred to in the present paper, thereby seeking to illustrate the variety of the remedy application mechanism if this may contribute to the more efficient protection of copyright. The thesis characterises the objectives of application of the civil remedies of copyright, reveals the legal nature of separate remedies, analyses conditions and peculiarities of application thereof, as well as studies the interconnection between separate remedies, poses individual problems pertaining to application of remedies and the shortcomings of legal regulation which prevent the efficient enforcement of the rights, and provides the probable alternatives of the solution of the problems exposed. The basic method of study used in the thesis is comparative. The model of legal regulation of copyright remedies chosen in this thesis is the one existing in the states of Germanic legal system, i.c. Germany, Switzerland and Austria, and based on this model, the issues of copyright remedies are analysed by way of comparing and assessing the remedies of copyright provided for in the Lithuanian legislation.In truth, the nature of compensation in lieu of reimbursement for a loss, being the remedy of copyright, originated in the law and court practices of the USA, therefore, when analysing this type of remedy, the reference is made on the law of this country, notwithstanding the fact that the copyright of the states upholding general law tradition is not dealt with in this paper. The institution of compensation is examined here on the basis of the court practices and provisions of the Russian Copyright law as well, since this institution is also known in the Russian copyright. The object chosen for the study in this thesis is the first attempt in the Lithuanian law doctrine to analyse a notably problematic sphere of private law, i.e. the application of civil remedies of copyright To date, no scientific works were maintained in Lithuania on the issues of protection of copyright. Therefore, from the point of view of legal doctrine, this paper is an entirely new work. The paper serves to be helpful for practice as well: both to the authors who may enjoy the remedies of copyright provided for in the legislation, and to the courts which protect the rights of the authors, since the efficient and productive exhaustion of rights depends on the appropriate application of remedies. Owing to the fact that, in addition to the aspects of application of separate remedies for infringement, the thesis reveals current problems and gaps in the legislation, therefore, this would prove to be valuable both to the legislature, which could rectify the existing obstacles with respect to the efficient enforcement of rights, and to the owners of copyright, not to mention the institutions dealing with the protection of rights, so that they could remove the existing shortcomings and difficulties by reasonable application of separate remedies.
