LDK žemės teismų darbo problema (1564-1588 m.)

LTStraipsnyje nagrinėjamas naujųjų savivaldžių LDK pavietų žemės teismų darbas pradiniame jų veiklos etape – pirmus du dešimtmečius, kai galiojo Antrasis Lietuvos Statutas. Formaliai naujojo tipo žemės teismai buvo įkurti administracinės ir teismo reformos metu 1564-1566 m. Iš tikrųjų šių teismų įkūrimas vietose vyko ne vienu metu ir apėmė laikotarpį nuo 1565 iki 1570 m. Paskutinysis pavieto žemės teismas įkurtas Polocko vaivadijoje, kurio didžiąją dalį tada buvo užėmusi maskvėnų kariuomenė (vyko Livonijos karas). II Lietuvos Statuto numatytas žemės teismų darbas – 3 sesijos į metus daug kur buvo nutraukiamas dėl įvairių buitinių (vietų teismo darbui neturėjimas, pareigūnų liga ar mirtis), politinių (bekaralmečiai, karai) ar stichinių (maro epidemija) priežasčių. Dėl pareigūnų kaitos dažnai ilgai tekdavo laukti ir naujų pareigūnų rinkimų (elekcijos). Straipsnyje nustatyta, kad daugiau ar mažiau sklandus pavietų žemės teismų darbas daugelyje LDK regionų nusistovėjo nuo 9-ojo XVI a. dešimtmečio pradžios, po minėto karo pabaigos. ENThe article investigates the work of land courts of the new self-governing districts of the GDL at the initial stage of their activity – during two decades when the Statute II of Lithuania was in force. Formally land courts of the new type were established at the time of the administrative and court reform between 1564 and 1566. Actually these courts were established at different time in their places and covered the period from 1565 to 1570. The last land court of the district was established in the voivode district of Polotsk whose larger part was occupied by the Muscovy army then (the Livonia war was going on). The work of land courts provided for in the Statute II of Lithuania – three annual sessions were cancelled in many places due to various everyday (absence of places for the work of the court, illnesses or death of officials), political (wars) reasons or plague epidemics. Because of a change of officials it took a long time for the elections of new officials to be held. The article establishes that more or less smooth work of district land courts in many regions of the GDL became settled at the beginning of the 9th decade of the 16th century, after the end of the said war. The work there most often was carried out in one place of the district according to the provisions of the Statute II of Lithuania.
