Užsienio teismų sprendimų pripažinimas ir vykdymas civiliniame procese : disertacija

LTMokslinio darbo tyrimo objektas – teismų sprendimų eksteritorialus galiojimas, jų vykdymo galimybės užsienio valstybėse bei užsienio valstybių teismų sprendimų pripažinimas kaip būtina prielaida jų vykdymui. Pirmojoje darbo dalyje analizuojama užsienio valstybių teismų sprendimų pripažinimo sąvoka, šio instituto vieta teisės sistemoje bei jo teisinio reglamentavimo šaltiniai, pripažintini teismų sprendimai, pateikiamos užsienio teismų sprendimų pripažinimo sistemos, išskiriami Lietuvos teismų sprendimų pripažinimo užsienio valstybėse modeliai, priklausomai nuo tarptautinio teisinio šio klausimo reglamentavimo tarp Lietuvos ir užsienio valstybės (ar valstybių grupės), kurioje siekiama Lietuvos teismo sprendimo pripažinimo. Antroje darbo dalyje nagrinėjama ekstraordinarinė teismų sprendimų vykdymo užsienio valstybėse galimybė be exequatur procedūros, o taip pat analizuojamas kitas glaudžiai su užsienio valstybių teismų sprendimų vykdymu susijęs klausimas – procesinių dokumentų civilinėje byloje įteikimas kitoje Europos Sąjungos valstybėje narėje. Trečiojoje darbo dalyje analizuojamas užsienio teismų sprendimų pripažinimo ir vykdymo teisinis reglamentavimas Lietuvos Respublikos civilinio proceso teisėje, apžvelgiama Lietuvos teismų praktika šioje srityje, lyginamas užsienio valstybių teismų ir arbitražų sprendimų pripažinimas ir vykdymas.Reikšminiai žodžiai: Užsienio teismo sprendimas; Pripažinimas ir vykdymas; Europos vykdomasis raštas; Foreign jujgment; Recognition and enforcement; European Enforcement Order.

ENThe object of research of the scientific thesis is the exterritorial effect of judgments, their enforcement possibilities in foreign states and the recognition of foreign judgments as a prerequisite for their enforcement. Chapter One of the thesis provides an analysis of the concept of recognition of court judgments of foreign states, the position of this institute in the legislative framework and the sources of its legal regulation, recognisable judgments, details the systems of recognition of foreign judgments, singles out the models of recognition of Lithuanian court judgments in foreign states in the light of international legal regulation of this issue between the Lithuania and a specific foreign state (or a group of the states) where the recognition of judgments given by Lithuanian courts is sought. Chapter Two of the thesis details the extraordinary enforcement opportunity of court judgments abroad without recourse to the exequatur procedure, as well as provides a study of other issues closely interrelated with the enforcement of foreign judgments - service of procedural documents in civil matters in other states of the European Union. Chapter Three of the thesis provides an analysis of the legal regulation of recognition and enforcement of foreign judgments in the law of civil procedure of the Republic of Lithuania, overviews the case-law of Lithuanian courts in this area, compares the recognition and enforcement of foreign judgments and arbitral awards.
