ENSo far, the review of unfair terms has been harmonized in terms of contracts between traders and consumers (B2C), whereas the protection from unfair terms in contracts between traders (B2B) varies from country to country. PECL, DCFR followed by CESL have suggested introduction of provisions dealing with unfair terms in B2B transactions. This suggests that regulation of unfair terms in B2B transactions cannot be undoubtedly excluded from the legislation without putting some efforts for analysis of the need for such legislation. This paper examines the provisions of Lithuanian Civil Code in terms of unfairness control, the concept of unfair terms control in B2B transactions suggested by PECL, DCFR, and CESL, as well as it provides some analysis of national legislation in several countries, where the content review of unfair terms in B2B transactions is established.
