ENIn the article genesis and contents of the Fundamental Principles of Temporary Constitution adopted by the Lithuanian State Council on November 2, 1918 and April 4, 1919 are investigated. The author intends to find out what these documents there are – two separate temporary constitutions or two versions of the same constitutional act. It is belief of the author that the Lithuanian State Council, being established and temporary institution, which inevitably had to perform the inaugural work, intended not to emphasize in the Fundamental Principles of Temporary Constitution matters constituting the prerogative of the Constituent Assembly. However, the Lithuanian State Council clearly established all the major elements of the state, the ideas of independency and sovereignty, as well as all the main human rights and freedoms. The Fundamental Principles of Temporary Constitution of 1918 is really the first Lithuanian Constitution. The Fundamental Principles of Temporary Constitution of 1919 have been adopted by the Lithuanian State Council as a new (the second) Lithuanian Constitution. [From the publication]
