The Issue of genesis of the institution of the President of the Republic of Lithuania in the constitutional process of 1990-1992

LTLR Prezidento konstitucinio instituto klausimas konstituciniame procese 1988 – 1992 m. buvo viena pagrindinių aktualijų atkuriant LR nepriklausomybę, o vėliau – kuriant Lietuvos valstybės institucinę sistemą. Šio proceso išskirtinis reiškinys buvo tai, kad politinė, teisinė polemika dėl valstybės vadovo kilo jau 1988 – 1990 m., kai Lietuvoje dar galiojo tarybinė konstitucija. [...] Valstybės vadovo konstitucinio instituto atkūrimo klausimo pobūdis iš esmės įgijo naują politinį teisinį turinį tada, kai 1990 m. kovo 11 d. buvo atkurta nepriklausoma demokratinė LR ir priimtas LR Laikinasis Pagrindinis Įstatymas (Lietuvos Respublikos laikinoji konstitucija). 1990 – 1992 m. konstitucinio proceso turinį lėmė nauja politinė teisinė tikrovė, kurioje pagrindinis akcentas buvo klausimas dėl LR būsimosios konstitucinės sąrangos, valstybės institucijų tarpusavio santykių, kompensacijos ir kt. LR Prezidento institucijos atkūrimo procesas LR Laikinojo Pagrindinio Įstatymo galiojimo laikotarpiu buvo sudėtingas, nes diskusija šiuo klausimu vyko aštriomis politinės konfrontacijos sąlygomis. [...] Kelyje į LR Prezidento instituto atkūrimą atskirai pažymėtini Lietuvos Sąjūdžio ir kitų politinių organizacijų veiksmai siekiant nedelsiant grąžinti į Lietuvos konstitucinę sistemą valstybės vadovo pareigybę ir nustatyti jo įgaliojimus. Nors šie pasiūlymai bei veiksmai komplikavo konstitucinį procesą, kad politinių jėgų siekis nedelsiant atkurti valstybės vadovo pareigybę laikantis Laikinojo Pagrindinio Įstatymo, skatino intensyviau rengti Konstituciją, spartino šį procesą. ENInstituting the Republic of Lithuania’s constitution in the constitutional process from 1988-1992 was one of the main issues in establishing Lithuania’s independence and later on, in establishing the country’s state institutional system. The unique phenomenon of this process was that the political and legal polemic for the government of state had already arisen in 1988-1990, when the Soviet constitution was still in force. The issue of creating a constitution for the government of state was essentially to acquire a new political legal content at a time when the democratic independent Republic of Lithuania was established, and the Interim Law (the interim constitution of Lithuania) was adopted. From 1990-1992 the matter of the constitutional process supported the new political-legal reality, the main issue of which was the structure of the future constitution and the relations between the state institutions, compensation, etc. Creating the presidential institution of the Republic of Lithuania when the Interim Law was in force was complicated, and discussion of this issue took place under tense, confrontational political conditions. […] The Sąjūdis movement and other political organisations were active in the creation of the presidential institution, seeking to return responsibility for the government of state to the constitutional system and bring it into effect without delay. Although these suggestions and actions complicated the constitutional process of attaining political power without delay and establishing responsibility for the government of state with the Interim Law, it encouraged more intensive preparation of the constitution and sped the process up.
