Implementation of public e-services for immovable property contracts in Lithuania

LTElektroninių viešųjų paslaugų vystymas laikytinas vienu iš pagrindinių informacinės visuomenės diegimo prioritetų. Ypač svarbu kuo greičiau ir efektyviau elektronines viešąsias paslaugas diegti valstybiniame sektoriuje. Viena iš tokių paslaugų diegimo sričių valstybiniame sektoriuje – VĮ „Registrų centras“ veikla ir teikiamos paslaugos. Kaip rodo praktika, prie VĮ „Registrų centras“ filialų driekiasi vis didesnės eilės asmenų, siekiančių įsigyti arba parduoti nekilnojamąjį turtą. Tokia situacija galėtų pasikeisti, jei pvz., nekilnojamojo turto registravimo procedūra būtų visiškai ar iš dalies perkelta į elektroninę erdvę. Straipsnyje analizuojamas nekilnojamojo turto sandorių viešosios elektroninės paslaugos (toliau – NETSVEP) informacinės sistemos įdiegimo tarp Registrų centro ir notarų modelis. Straipsnyje aptariami ir analizuojami daiktinių teisių į nekilnojamąjį turtą registravimo procedūros metu perduodamos informacijos teisinės galios, notaro identifikavimo, daiktinių teisių į nekilnojamąjį turtą registravimo procedūros ir kiti teisiniai aspektai. Taip pat dėmesys skiriamas ir NETSVEP informacinės sistemos diegimo Lietuvoje organizaciniams aspektams. ENDevelopment of electronic public services is to be considered a priority of implementing the information society. It is particularly important to implement electronic public services in the governmental sector. One of such areas of implementation is the activity of the Centre of Registries. The practice has shown that lines of persons willing to purchase or sell real estate at the Centre of Registries are getting longer. The situation can change if, for example, the property registration procedure were to be fully or in part transferred to the electronic space. The article analyses the model of implementing the real estate transaction public electronic service (RETPES) information system between the Centre of Registries and notaries. The article deals with and analyses the aspects of legal power of information transferred in the process of registration of real rights to real estate, notary identification, the procedure of registration of real rights to property, etc. It also takes account to the organisational aspects of implementing the RETPES IS in Lithuania.
