Autorius parodo, kad ši riba kol kas pavojingai neaiški, paliekanti daug laisvės interpretacijoms. Baudžiamosios teisės ir verslo santykis tampa neatsiejamu junginiu, kurį būtina įvertinti baudžiamosios justicijos požiūriu. ENThe article attempts to draw a distinction between the corporate risk in trusting business partners and criminal liability. The author illustrates that such distinction is rather vague, indefinite and risky, and leaves a plenty of freedom for interpretation. Relationships between criminal law and business have become an inseparable compound to be rated from the point of view of criminal justice. It should be noted that the research in the analysed topic has been scarce in Lithuania. Some of its aspects have been researched by scholars of criminal law such as A. Abramavičius, O. Fedosiuk, V. Piesliakas, G. Ivoška and J. Misiūnas. The increasing number of criminal cases where corporate disputes involve elements of criminal law should also be noted. The most frequent accusations in corporate disputes include fraud, misappropriation of property and embezzlement, criminal bankruptcies, debtors dishonesty, legalization of illicitly acquired assets and abuse of office. Complex business transactions and their international nature determined that in the case of the dispute between counterparties it is more and more difficult to answer the question: is it a civil legal relationship or criminal offense. So, at this point there is a risk as prosecutors might be supporting one side of the businessmen and starting using measures of criminal procedure. [From the publication]
