Kolektyvinės sutartys valstybės tarnyboje

LTStraipsnyje nagrinėjami kolektyvinių sutarčių sudarymo valstybės tarnyboje ypatumai. Nagrinėjamos problemos esmė – kolektyvinių sutarčių turinio ypatumai valstybės tarnyboje, policijoje ir krašto apsaugoje. Valstybės tarnybos įstatymas numato kolektyvinių sutarčių valstybės tarnyboje turinio ypatumus. Vidaus tarnybos statutas, reglamentuojantis policijos pareigūnų tarnybą, kolektyvinių sutarčių ypatumų nenustato, todėl policijos pareigūnams taikomi tokie pat kolektyvinių sutarčių turinio ypatumai kaip ir valstybės tarnautojams. Krašto apsaugos profesinės karo tarnybos kariams ir civilinės krašto apsaugos tarnybos statutiniams tarnautojams draudžiama būti profesinės sąjungos nariais. Kadangi kolektyvinių derybų teisė kildinama iš teisės vienytis į organizacijas, galima konstatuoti, jog kolektyvinių derybų teisė profesinės karo tarnybos kariams ir statutiniams tarnautojams nesuteikiama. Kalbant apie tarptautinį kolektyvinių sutarčių sudarymo valstybės tarnyboje reglamentavimą pažymėtina, kad tarptautinė darbo organizacija numato kolektyvinių derybų valstybės tarnyboje išimtis. ENThe article examines the special features of concluding collective agreements in the civil service. It looks at the content of collective agreements in the civil service, police and defence. The Law on Civil Service describes the special features of the content of collective agreements. The Statute of the Interior System regulating the service of police officials does not provide for the conclusion of collective agreements. Therefore, collective agreements concluded by the police officers are the same as those entered into by the ordinary civil servants. The professional servicemen of the defence system and statutory civil servants of the civil defence are not allowed to be members of trade unions. As the right of collective negotiations originates from the right of association, it could be inferred that the right of collective negotiations is not granted to professional servicemen and statutory civil servants. With regard to the international regulation of collective agreements in civil service, that the International Labour Organisation provides for the exceptions of collective negotiations in the civil service.
