LTCivilinis kodeksas galioja jau penkerius metus, bet ne visi kodekse numatyti teisės institutai taikomi. Straipsnyje analizuojamas sandėliavimo verslui reikšmingas sandėlių dokumentų institutas, šio instituto teisinė prigimtis, reikšmė įkeitimo santykiams, įkeitimo, pasaugos rūšies – sandėliavimo – kodifikuotų teisės normų santykis su specialiomis teisės normomis, įtvirtinančiomis sandėliavimo dokumentų sistemą, pastebėti šių teisės normų prieštaravimai bei galimybės kitaip reguliuoti sandėliuojamų prekių įkeitimą, nei nustato bendros įkeitimo taisyklės, o tai galbūt paskatintų komercinius bankus naudotis nauju produktu įkeitimo rinkoje – sandėliavimo dokumentais. ENThe Civil Code has been valid for five years but does not apply to all of the legal institutions. This article analyses the significance of the storage documenting institution for the storage business, the legal nature of this institution, its significance for hypothecation relations, hypothecation, the relationship between the type of service – storage – and codified norms of law and special norms of law, implementing the storage document system, objections to these norms that have been raised and the options for regulating the storage of hypothecated goods differently, which could encourage commercial banks to use the new products in the hypothecation market – storage documents.
