Соотвествие поведения судей требованиям процедурной справедливости (на примере литовского судопроизводства)
LTTeisminio nagrinėjimo rekonstrukcijai buvo naudojama autorių sukurta teisėjų elgesio stebėjimo metodika. Specialiai parengti tyrėjai stebėjo 103 teismo posėdžius, vykusius viename Vilniaus apygardos teisme ir trijuose apylinkės teismuose. Siekiant nustatyti, kiek naudojamos teisminio nagrinėjimo procedūros padeda ar trukdo teisingumo jausmo susiformavimui, buvo naudojamas ekspertinio vertinimo metodas. Gauti rezultatai parodė, kad skirtingose situacijose teisėjų elgesio atitikimas procedūriniam teisingumui stipriai svyruoja (nuo 0 proc. iki 80 proc.). Buvo nustatyti reikšmingi skirtumai tarp skirtingų teisėjavimo stilių, o taip pat tarp realaus teisėjų elgesio ir ekspertų vertinimo. ENThe present investigation examined the correspondence of judges’ behaviour to the established requirements of procedural justice. The method of observation of judges’ behaviour was specially constructed for this research. Observers after special training observed 103 court trials of three citys’ courts and the one district court of Vilnius. The role of the court trial procedures in the formation of feeling of justice was assessed by the method of experts. The results indicated, that the correspondence of judges’ behaviour to the requirements of procedural justice was very different in different situations (it fluctuates from 0 to 80 procent). It was found, that the above-mentioned correspondence depends on the peculiarities of the representation of these requirements in the processual law. It was also confirmed, that there are considerable differences between the different styles of judging as well as between the real behaviour of judges and the evaluations of experts. The results suggest that for the instillation of the requirements of procedural justice into the criminal process we need to formulate the requirements for judges’ behaviour as precise and detailed norms of law.
