ENMurder is one of the most dangerous criminal offences against human life. Every year about 200 of these crimes are committed in the Republic of Lithuania and it is the highest number of murders for 100 000 inhabitants in the European Union. But not only the abundance of these crimes causes problems. The courts adjudicating cases of murders still find difficulty in qualifying the crime in the category of murders. One of the reasons might be that until now it is not completely clear what murder actually is. Radical variations can be seen in one of the presented cases where the court concludes an activity to be manslaughter while the higher court recognized it as a murder which is a completely different decision. Such conflicting decisions of different courts confirm that the concept of murder causes lots of significant qualifying problems, some of which are discussed in this article. [From the publication]
