LTŠiame straipsnyje analizuojama vidutinio darbo užmokesčio už priverstinės pravaikštos laiką instituto samprata, pateikiamas priteisiamos sumos mažinimo problemos vertinimas, tiriami LR DK 300 straipsnio pakeitimai, įsigalioję 2013 m. sausio 1 d. Daug dėmesio skiriama Lietuvos Aukščiausiojo Teismo suformuluotų pozicijų analizei ir jų vertinimui, todėl pateikiama minėto instituto tobulinimo pasiūlymų ne tik įstatymų leidėjui, bet ir teismų praktikai. Straipsnyje daroma išvada, kad įstatymų leidėjo reakcija į praktikos poreikius kol kas nėra adekvati, ir siūloma ją tobulinti. [Iš leidinio]
ENThis article deals with problems, which occur when an employee is awarded with compensation of average wage for the entire period of involuntary idle time. The purpose of the research is to compare different editions of Lithuanian Labour Code (acting edition until the 31st of December, 2012 and acting edition since the 1st of January, 2013) regulating compensation of average wage for the entire period of involuntary idle time. In order to achieve this goal the following tasks were formulated: to analyse the goal and functions of this legal instrument, formulated by Lithuanian jurisprudence so far, to evaluate reduction possibilities made by Lithuanian Supreme Court, to scrutinise recent changes of Lithuanian Labour Code and to give suggestions on modification of Lithuanian legal acts and Lithuanian jurisprudence. Methods of scientific analysis of documents and literature as well as logical, comparative ant theological methods were used. Based on legal acts, jurisprudence of Lithuanian Supreme Court and scientific researches, the article concludes that recent changes of Lithuanian Labour Code failed to solve practical problems entirely. They do not correspond to practical needs and cause additional implementation problems. Therefore suggestions to improve legal regulation and tendencies for Lithuanian jurisprudence are made in the conclusions of the article. [From the publication]
