LTRemiantis 2009–2012 m. Lietuvos Respublikos pirmosios instancijos teismuose priimtais teismo nuosprendžiais, šiame darbe pateikiama kriminologinė atsakomybės už nusikaltimus, susijusius su disponavimu narkotinėmis ir psichotropinėmis medžiagomis, analizė. Pasinaudojus oficialios statistikos ir reprezentatyvių Lietuvos gyventojų apklausų duomenimis, atskleidžiama dabartinė situacija Lietuvoje. Pristatoma teismo nuosprendžių analizė, kurioje aptariamos nuteistųjų socialinės demografinės (amžius, išsilavinimas, lytis, santuokinis statusas, užimtumas, teistumas) charakteristikos, pareikšti kaltinimai, straipsniai, pagal kuriuos skirtos bausmės, ir skirtų bausmių charakteristikos. Pateikiamas nuteistųjų socialinių demografinių charakteristikų ryšys su Baudžiamojo kodekso straipsniais, pagal kuriuos buvo skirtos bausmės. Taip pat atskleidžiamas ryšys tarp nuteistųjų charakteristikų ir jiems skirtų bausmių. ENIn accordance with judgements adopted in courts of first instance of the Republic of Lithuania during 2009-2013, the work presents criminological analysis of liability for crimes relating possession of narcotic and psychotropic substances. The work analyses social demographic characteristics of convicts (age, education, sex, marital status, employment, previous convictions), the charges submitted, articles under which penalties were imposed, and characteristics of imposed penalties. Relation between the social demographic characteristics of convicts with Articles of the Criminal Code under which penalties were imposed is presented. As well, the work discloses relation between the characteristics of convicts and penalties imposed upon them. Results of this research are compared with results of the research carried out back in 2009. Analysis of official statistical data showed that a number of criminal acts relating disposal of narcotic, psychotropic, toxic or highly psychoactive substances is rising in Lithuania. According to the analysis of convictions for the mentioned acts, men are convicted more often than women. Young persons, aged 21-30, dominate among the convicts. Most convicts have secondary education. Majority of convicts had not been officially married. As well it was established that the vast majority of convicts were unemployed prior to the detention and had been at least once convicted previously.In most cases persons were convicted for unlawful producing, processing, acquisition, storage, transportation or forwarding of narcotic or psychotropic substances for the purpose other than selling or otherwise distributing them (Art. 259 CC). However, it was noticed, that during the last four years twice more persons were convicted for unlawful possession of narcotic and psychotropic substances for the purpose of distributing them or unlawful possession of a very large quantity of narcotic or psychotropic substances (Art. 260 CC). Accordingly, characteristics of penalties imposed have changed. Comparing the results of this research with the results of the research carried out in 2009, it was noticed that imprisonment was imposed in 10 per cent more cases and this penalty composes the largest part of all penalties. At the same time, imposition of fines decreased in 15 per cent. [From the publication]
