LTStraipsnio tikslas – išnagrinėti ir palyginti Europos Sąjungos ir Lietuvos Respublikos teisės aktuose pateikiamų duomenų bazės sąvokas. Šis klausimas Lietuvos mokslinėje literatūroje nėra tyrinėtas. Iškeltam tikslui pasiekti analizuojami Lietuvos Respublikos ir Europos Sąjungos teisės aktai, Europos Teisingumo Teismo ir Europos Sąjungos valstybių narių nacionalinių teismų sprendimai, užsienio šalių teisės teoretikų darbai. Pirmoje straipsnio dalyje nagrinėjamas 1996 m. kovo 11 d. Europos Parlamento ir Europos Sąjungos Tarybos direktyvos 96/9/EB dėl duomenų bazių teisinės apsaugos pateikiamas duomenų bazės apibrėžimas, antroje – Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatyme įtvirtintas duomenų bazės apibrėžimas. Analizė atskleidžia, kad pastarasis neatitinka duomenų bazės apibrėžimo, pateikto Direktyvoje, ir šis neatitikimas gali būti laikomas Direktyvos nuostatų pažeidimu. Autorius siūlo suvienodinti Lietuvos Respublikos autorių teisių ir gretutinių teisių įstatymą su Direktyva. Straipsnyje remiamasi istoriniu, sisteminiu, loginiu, lingvistiniu tyrimo metodais. ENThe article aims to examine and compare the concept of database in the law of the European Union and the Republic of Lithuania. This issue has not been previously studied in the academic literature of Lithuania. The article analyses the laws of the Republic of Lithuania and the European Union, the decisions of the European Court of Justice and the national courts of the EU Member States, as well as theoretical works by foreign scholars of law. The first part of the article examines the definition provided by Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases, while the second part – the definition established in the Law on the Rights of authors and Related Rights of the Republic of Lithuania. The analysis shows that the latter definition does not correspond to the definition of the database provided in the Directive and that this discrepancy may be considered a violation of the Directive’s provisions. The author suggests harmonising the Law on the Rights of Authors and Related Rights with the Directive. The article uses historical, systemic, logical and linguistic research methods.
