Ratification of the treaty establishing a constitution for Europe in Lithuania and its impact on the national constitutional system

LTStraipsnyje aptariamas Sutarties dėl Konstitucijos Europai ratifikavimo procesas Lietuvoje, analizuojama šios sutarties prigimtis ir jos įtaka nacionalinei konstitucinei sistemai. Pažymima, kad nors šios sutarties įsigaliojimo perspektyvos tebėra miglotos, daugeliu atvejų jos nuostatos rodo dabar egzistuojantį status quo, todėl jų analizė išlieka svarbi. Turint galvoje specifinius Europos Sąjungos (ES) bruožus ir jos konstitucines ambicijas vertinama, kaip jas atspindi ES konstitucinė sutartis. Taip pat analizuojama, ar ES konstitucinės sutarties nuostatos pakeistų ES ir nacionalinės teisės sistemų santykio pobūdį ir kaip jos paveiktų konstitucinių konfliktų tarp šių teisės sistemų atsiradimą bei sprendimą.Galiausiai, turint omenyje pirmiau aptartus aspektus, sprendžiama, ar šiai sutarčiai ratifikuoti Lietuvoje buvo būtinos Lietuvos Respublikos Konstitucijos pataisos. ENThe article discussed the process of ratification of the Treaty establishing a Constitution for Europe in Lithuania, as well as analyses the nature of this treaty and its influence on the national constitutional system. Although the prospects that this treaty will come into effect are still rather vague, in many regards its provisions indicate the existing status quo and, therefore, their analysis remains important. Taking into account the specific features of the European Union (EU) and its constitutional ambitions, the article examines how it is reflected in the EU constitutional treaty. The article also analyses whether the provisions of the EU constitutional treaty would change the nature of the relation between the EU and the national legal systems and how it would affect the emergence and the resolution of constitutional conflicts between these systems of law. Finally, with regard to the previously discussed issues, the article deliberates whether the ratification of this treaty in Lithuania required amendments to the Constitution of the Republic of Lithuania.
