Socialinių partnerių vaidmuo kuriant Europos Bendrijos darbo teisės normas

LTStraipsnyje nagrinėjamas socialinių partnerių vaidmuo Europos Bendrijos teisės normų kūrimo procese. Pirmoje dalyje aptariamas formalaus ir neformalaus socialinio dialogo Bendrijos lygmenyje atsiradimas ir jo evoliucija, kurios metu tarptautinės darbdavių ir darbuotojų organizacijos iš paprastų stebėtojų tapo teisės normų kūrimo proceso dalyviais su itin plačia kompetencija. Socialinių partnerių įtraukimas į darbo teisės normų kūrimą laikomas vienu iš unikalaus Europos socialinio modelio bruožų. Socialinių partnerių sąvoka ir jos reikšmė yra analizuojama antrojoje straipsnio dalyje. Europos Bendrijos steigimo sutartis nepateikia pripažintų socialinių partnerių sąvokos, todėl autorius kritiškai vertina Bendrijos institucijų, Europos Teisingumo teismo požiūrį į tai, kokios organizacijos gali būti laikomos kompetentingomis dalyvauti socialiniame dialoge. Trečioji straipsnio dalis skirta darbdavių ir darbuotojų organizacijų dalyvavimui Bendrijos teisėkūroje konsultacijų ir derybų būdais, ypatingą dėmesį skiriant problemiškiems pasiektų susitarimų teisinės prigimties, sudarymo ir įgyvendinimo aspektams. Autorius pasisako už aiškų konsultacinės ir reguliacinės funkcijų atribojimą, suteikdamas šioms teisėms skirtingą reikšmę, kritikuoja demokratinį deficitą, kuris pasireiškia įgyvendinant pasiektus socialinių partnerių susitarimus Vertindamas Europos socialinio dialogo perspektyvas, autorius mano, kad šiandieninis socialinių partnerių bendradarbiavimo Bendrijos lygmenyje modelis yra platus žingsnis kuriant supranacionalinių kolektyvinių derybų ir kolektyvinių sutarčių sistemą Europoje. ENThe article examines the role of social partners in the process of the development of the European Community’s legal norms. The first part discusses the emergence and the evolution of formal and informal social dialogue at the Community level, whereby international employer and employee organisations became participants with particularly wide powers, rather than mere observers, of the legal norms development process. The inclusion of social partners in the development of the norms of labour law is considered to be one of the features of the unique European social model. The second part of the article analyses the concept of social partners and its meaning. The founding treaty of the European Community does not contain the concept of recognised social partners; therefore, the author has a sceptical view with regard to the opinion of the Community’s institutions and the European Court of Justice as to which organisations are considered eligible for participation in the social dialogue. The third part of the article discusses the participation of employer and employee organisations in the legislative process of the Community by way of consultations and negotiations, focusing particularly on the problematic issues of the legal nature of negotiated agreements, as well as their formation and implementation. The author argues for a clear separation of the consultative and the regulatory functions, assigning different meaning to these rights, and criticises the democratic deficit, which becomes apparent in the implementation of the agreements achieved by the social partners. In assessing the prospects of the European social dialogue, the author argues that the current model of social partnership at the Community level is a significant step towards the creation of supranational collective bargaining and collective agreements in Europe.
