Summary / Abstract:

LTAkivaizdu, jog pastaruoju metu siekiant mokslo plėtros yra būtinas įvairiapusis keitimasis informacija bei specialiosiomis žiniomis, todėl ir šio straipsnio vienas pagrindinių tikslų – parodyti ar tiesiog priminti dviejų disciplinų sąveiką. Šiame straipsnyje, analizuojant Europos Sąjungos Teisingumo Teismo jurisprudenciją, pateikiama, kaip persipina ir viena kitą papildo aplinkos apsaugos bei aplinkos teisės disciplinos ir kokią reikšmę ši sąveika turi praktikoje. Pristatomas Teisingumo Teismo, kaip vienos iš Europos Sąjungos institucijų, statusas ir nagrinėjamų bylų, reikšmingų aplinkos apsaugai, procedūrų pobūdis. Teisingumo Teismo jurisprudencija apžvelgiama remiantis teisės doktrinoje išskiriamais teisės į sveiką aplinką turinio elementais – žmogaus teisėmis, sveika aplinka ir aplinkos apsauga. ENEnvironmental policy of the European Union pursues the following goals: to preserve, protect and improve environment quality; to protect human health; an efficient and sparing use of natural resources; and the respect of international treaties and conventions on climate change and environmental issues. Because the European Union environmental policy is applied in several countries, it takes into consideration the particularities of each EU region. The policy implementation is based particularly on the precautionary principle, the principle of rectification of pollution at its source and the polluter-pays principle. The Republic of Lithuania as a member of the EU is obliged to pursue all the above-mentioned goals when implementing its environmental policy. The Court of Justice of the European Union when interpreting the EU legal texts creates and develops environmental law, especially in the procedures concerning the actions for failure of a member state to fulfil its obligations and the preliminary ruling procedure. The active role of the Court of Justice in health-related and environmental issues may also be observed in cases concerning waste management, genetically modified organisms and air and water pollution.In recent years, the Court of Justice case law shows that the right to a healthy environment and the implementation of environmental policies are under constant development. The protection of the right to a healthy environment has become not only an aspiration but also an objective sanctioned by legal instruments. [From the publication]
