LTDisertacijos tyrimo objektas yra Lietuvos profesinių sąjungų teisinė padėtis. Kadangi profesinės sąjungos istoriškai buvo sukurtos kaip darbuotojų teisių ir interesų gynėjos, darbe analizuojama profesinių sąjungų istorinė kilmė, jų atsiradimas ir raida Lietuvoje, taip pat profesinių sąjungų teisinė padėtis ir jos raida tarptautiniuose teisės aktuose ir užsienio valstybių teisės normose. Darbe taip pat analizuojama profesinės sąjungos sąvoka ir jos sudedamieji požymiai, profesinių sąjungų steigimo Lietuvoje problemos, reikalavimai profesinių sąjungų steigėjams, profesinių sąjungų įsteigimo momentas, teisės jungtis į profesines sąjungas ribojimai, profesinių sąjungų ir darbo tarybų santykis, profesinių sąjungų subjektiškumas kolektyviniuose darbo santykiuose, atstovaujančios profesinės sąjungos problemos, profesinių sąjungų teisės sudaryti kolektyvinę sutartį, profesinės sąjungos kaip kolektyvinių darbo ginčų šalies problema, profesinių sąjungų teisės individualiuose darbo santykiuose. Pagrindinis disertacijos tikslas - teoriniu ir praktiniu aspektu išanalizuoti ir įvertinti Lietuvos profesinių sąjungų teisinę padėtį, nustatyti profesinių sąjungų veiklos teisinio reguliavimo problemas darbo teisinių santykių srityje ir pasiūlyti šių problemų sprendimo būdus. ENThe subject matter of the thesis is the legal status of trade unions in Lithuania. Since trade unions were created to protect workers’ rights and interest, the thesis analyses the historical origin of trade unions, their development in Lithuania, the legal status of trade unions and their development in international legal acts and legislation of foreign countries. It also analyses the concept of the ‘trade union’ and its constituent features, the problems of establishment of trade unions in Lithuania, the requirements set for their founders, the moment of establishment of trade unions, the limitation of the right to join trade unions, the relation between trade unions and labour councils, the subjectivity of trade unions in collective labour relations, problems of representational trade unions, the right of trade unions to conclude collective agreements, trade unions as a problem of collective labour disputes, and the rights of trade unions in individual labour relations. The main objective of the thesis is to make a theoretical and practical analysis of the legal status of Lithuanian trade unions, identify the problems related to the legal regulation of the operation of trade unions in the area of legal relations and provide proposals about how these problems could be addressed.
