LTNuo 2010 m. kovo 1 d. Lietuvos Respublikos pacientų teisių ir žalos sveikatai atlyginimo įstatymo trečiojoje redakcijoje įsigaliojo teisinis reguliavimas, kuris, lyginant su ankstesne redakcija, naujai apibrėžia kokybiškų sveikatos priežiūros paslaugų sąvoką bei atitinkamai nustato paciento teisės į kokybiškas sveikatos priežiūros paslaugas atitikties sąlygas ir kriterijus. Tačiau pozityviojoje teisėje tiesiogiai nėra nustatytas ir detalizuotas šių kokybiškų sveikatos priežiūros paslaugų sąlygų ir kriterijų turinys. Tik tinkamas sveikatos priežiūros paslaugų kokybės sąvoką sudarančių sąlygų ir kriterijų turinio atskleidimas leidžia nustatyti, ar yra pažeista paciento teisė į kokybiškas sveikatos priežiūros paslaugas, todėl pagrindinis šio straipsnio autoriaus tikslas – paciento teisės į kokybiškas sveikatos priežiūros paslaugas teorinė turinio analizė. ENSince 1 March 2010, the third version of the Law on the rights of patients and compensation for health damage of the Republic of Lithuania became effective. It forces on the legal regulation, which in comparison with the previous version, newly defines the concept of high-quality health care services and the conditions and criteria to determine the patient’s right to quality of health care services. However, the positive law does not establish and details conditions and criteria for the content of quality of health care. Therefore, the main objective of this article is the theoretical analysis of the patient’s right to try quality health care services. The author attempted to reveal the content and possible requirements of each component of health care service quality (conditions and criteria). The quality health care concept from the version of the Law on the rights of patients and compensation for health damage of 2009 does not contain the necessary or unnecessary conditions and criteria. Each condition and criterion of health care quality assessment has certain characteristics and peculiarities which must be taken into account for the proper evaluation of the legal case. The author identified the requirement for modern medicine and good level of experience for the in health care quality element enshrined in the Law on the rights of patients and compensation for health damage. This requirement is relevant in that the entities evaluating the quality of health care services not only have a duty to follow the provisions of legislation regarding the requirements governing the health care services, but also must mandatory assess whether the said legislation and its requirements define the health care delivery process (delivery of clinical case) and meet the good experience (practice) achievements of modern medical and nursing education.In conclusion it should be noted that the disclosure of constituent elements comprising the definition of right quality of healthcare concept – the conditions and criteria – enables the entities interpreting and applying it to determine whether there is a breach of the patient’s right to high quality health care services. Violation of the right to high quality health care services is only possible due to the non-compliance of the criterion of the concept of high quality of health care delivery conditions. Violation of the right to high quality health care services is possible if the entity violates any of the conditions or criteria analyzed. [From the publication]
