Lietuvos teisinių institucijų intelektinės schemos šalies teisinėje sistemoje : recenzija

LTPasak recenzento, vadovėlis “Lietuvos teisinės institucijos“ yra gerąja to žodžio reikšme monografinio lygmens leidinys, tinkamas plačiai skaitytojų auditorijai - nuo studento, doktoranto iki profesionalaus teisininko. Leidinio kalba, nors ir rašyta didelio autorių kolektyvo, - aiški, logiška, taisyklinga. Šiuo požiūriu vadovėlis gali (ar turi) būti skaitomas visų, kuriems rūpi valstybės valdžios įgyvendinimo veiksmingumo problemos Lietuvoje. Recenzento teigimu, aukšta moksline gaida, intelektinėmis kategorijomis pateikiami ne tik vadovėlio strategijos metmenys, bet ir visos Lietuvos teisinių institucijų sistemos koncepcija. Studento kritiškai diskrecinis mąstymas įvardijamas ir kaip pagrindinis vadovėlio ugdomasis tikslas. Recenzijoje tvirtinama, jog diskusinio bendravimo su bendraautoriais ir skaitytoju modelis yra profesionaliai iškilus ir formuoja pagarbius bendravimo santykius, parodo, pasak recenzento, kad akademinėje realybėje gali formuotis nauji profesinio lygmens santykiai ne tik tarp dėstytojų, bet raginant prie tokio bendravimo stiliaus jungtis ir studentus, kitus skaitytojus. ENAccording to the reviewer, the textbook Lietuvos teisinės institucijos (“Lithuanian legal institutions”) is, in the best sense of the word, a monographic-level publication suitable for a broad audience of readers – from the undergrad or doctoral student to the professional lawyer. Although written by a large group of authors, the language of the publication is clear, logical and accurate. In this respect, the textbook can (or should) be read by everyone who cares about the problems of the effectiveness of implementing state power in Lithuania. According to the reviewer, not only is the outline of the textbook’s strategy presented with a high academic note and intellectual categories – the concept of the entire system of Lithuanian legal institutions is as well. The student’s critical discretionary thinking is also cited as the textbook’s primary educational goal. It is asserted in the review that the model of discussional interaction with the co-authors and the reader is professionally prominent and forms deferential relations of intercourse; according to the reviewer, it shows that new professional-level relationships can be formed in academic reality not only between teachers, but by encouraging students and other readers to join in on this style of communication. The content of the textbook encourages the reviewer to raise two possible directions of discussion which are related to the educational goals of legal reasoning. First, the reviewer seeks to evaluate the content of the textbook, ascertaining to what extent the textbook is monographic and whether this style corresponds to students’ legal reflections; second, whether the textbook written in accordance with the positions of positive law forms students’ thinking in the direction of mechanical formalism.
