Teisingumo krizė ir valstybės modernizacijos galimybės

LTPublikacijoje svarstomos teisingumo krizės priežastys, sutelkiant dėmesį į politinių sprendimų padarinius ir pagrindines potencijas, būtinas ateities projektavimui. Straipsnyje vertinamos politinių jėgų veiklos formos, būdai ir padariniai, kurie sudaro tam tikrą pagrindą tikėtis, kad valstybės valdžia pasimokys iš valstybės kūrimo nesėkmių, paisys labiausiai kvalifikuotų profesionalų patarimų, visos visuomenės interesų. Taip pat konstatuojama, kad valstybė smuko į krizę, nerodančią pragiedrulių: tokiais atvejais pabunda savisaugos instinktas, verčiantis ieškoti lemtingų, kartais gana rizikingų sprendimų. Darbe pabrėžiama, kad daugiausia visų aptariama – finansinė valstybės krizė, bet daug pavojingesnė yra atsakomybės ir teisingumo krizė, kurios niekas iki šiol rimtai nepradėjo analizuoti. Vieni mano teisingumą įgyvendinę grąžindami teises į išlikusį nekilnojamąjį turtą, kiti galvoja, kad viskas bus gerai, užbaigus teisinę reformą, treti teisingumą tapatina su laisvąja rinka, o ketvirti – sustabdžius strateginių objektų privatizaciją. Išvadose teigiama, kad partijų programos ir valdžios keitėsi, o nereikalingų žmonių tik daugėjo. Partinės alternatyvos iš esmės nenumato nei savo programų įgyvendinimo terminų, nei jų veiklos padarinių analizės, nei motyvuoto aptarimo, kiek pasirinkti veiksmai ir priemonės yra efektyvios ir gali sustiprinti valstybės teisingumą. ENThe publication deals with the causes of crisis of the justice, while concentrating on the consequences of the political solutions and the main potencies, which are necessary for the future designing. The article assesses forms, methods and consequences of the political power activity, which create the reason to believe that the state government will learn from the setbacks of the creation of the state and will take into consideration the advices of the most qualified professionals and the public interest. In addition, it is declared that the state was in crisis, which did not promise any good: in these cases, the instinct of self-preservation, which forced to search for the fateful and sometime risky decisions. The article emphasizes that the discussion is mostly about – financial crisis of the state, although much more dangerous is the responsibility and justice crisis, which was not yet seriously analysed. Some believe that the justice is implemented when the rights to the Real Estate are reinstated. Others believe that everything will be fine, when the legal reform will be finished. The third group identifies the justice with the free market, the fourth group – with the suspension of the privatisation of strategic objects. The conclusions state that the programmes of the party and the government changed, and unnecessary people multiplied. Basically, the alternatives of the parties do not anticipate not only their deadlines of the realization of the programmes but also the analysis of the consequences of their activity and the motivated discussion on how effective and able to strengthen the justice of the country are the chosen actions and measures. On the other hand, that anticipation does not have a bigger meaning, if there is no real responsibility, only many evasions.
