LTStraipsnyje nagrinėjama naujojo Lietuvoj Respublikos baudžiamojo kodekso1 (toliau - LR BK), įsigaliojusio 2003 m. gegužės 1 d.2 , 54 straipsnio trečioji dalis. Šiuo tikslu yra apibūdinama teisingumo principo samprata, turinys. Visų pirma trumpai aptariama šio principo samprata teisės teorijoje. Detaliau teisingumo principo turinys yra nagrinėjamas baudžiamosios teisės kontekstu ir sukonkretinamas pagal bausmės skyrimo institutą. Aptarus teisingumo ir teisėtumo principus, analizuojamos naujojo LR BK 54 straipsnio trečiosios dalies teismui suteikiamos bausmės pasirinkimo galimybės, nagrinėjamos teismo diskrecijos, taikant šią normą, ribos. ENPart 3 of the Article 54 of the new Criminal Code of the Republic of Lithuania (herein after - CC RP), which became in force from 1 May 2003 is being analysed in this article. Analysing this provision the greatest attention is paid to the consideration of the justice principle conception, besides, non-identity of the justice and legitimacy conceptions are revealed. Those principles, first of all, are discussed in the plane of law theory. Further on, their conception in the criminal law are detailed and they are concretised within the pale of imposition of sentence institution. This article is based on the works of Lithuanian and foreign authors, the formed doctrine of the Constitutional Court of the Republic of Lithuania and practice of the Supreme Court of Lithuania. The author concludes the following: justice and legitimacy are not identical concepts; both of those principles are necessary and they compliment one another, besides, any of the imposed sentence must be both just and legitimate; the court on the basis of Part 3 of the Article 54 of CCRP may impose both a more lenient sentence then the established sentence minimum provided in the sanction of the article for a committed criminal act and a milder type of sentence then it is established in the sanction of the article for a committed criminal act; application of the Part 3 of the Article 54 of the new CCRP is not fully at the discretion of the court because the court, while imposing a sentence, can follow this provision only in this case when, after being applied other articles of the new CCRP which allow to milder the imposing sentence, nevertheless thinks that the imposing sentence clearly contradicts to the justice principle.
