LTStraipsnyje aptariamos pagrindinės sumarinio proceso formos naujajame CPK. Pateikiama jų esmės ir paskirties analizė, aptariami šių formų panašumai ir skirtumai. Straipsnyje taip pat lyginamos iki naujojo kodekso įsigaliojimo egzistavusios sumarinio proceso formos su naujosiomis, pateikiami pagrindiniai skirtumai. ENThe article deals with the main forms of summary procedure in the new Code of Civil Procedure of the Republic of Lithuania. Innovations of the new Code of Civil Procedure of the Republic of Lithuania are compared to 1964 Soviet Code of Civil Procedure. The new Code of Civil Procedure determines three main forms of summary procedure: court order procedure, documentary procedure and peculiarities of dealing cases concerning minor sums. The article deals with the basic features of the forms of summary procedure. It could be emphasized that three main forms of summary procedure mentioned above conditionaly could be divided into two groups one of which combines court order procedure and documentary procedure and another - peculiarities of dealing cases concerning minor sums. The main feature characterizing the first group is that the party is free to decide whether to choose summary proceduгe or common procedure to defend the rights. Whereas in a second case the court applies exceptional rules ex officio. The common feature to all forms is that legal rules regulating them are of exeptional character, c. i. they define only exeptions from the common rules of litigation. If there is no exeption determined the court applies common legal rules. Rather great importance is granted to economic measures encouraging parties to use quicker procedure of defence (lower stamp - duty, etc.). Moreover the essence of the forms of summary procedure, areas of application and peculiarities are also discussed in the article. [From the publication]
