LTStraipsnyje analizuojama šiuolaikinės ekonominės teisės analizės paradigma. Pateikiamos daugiausiai iš neoklasikinės ekonomikos perimtos metodologinės paradigmos prielaidos: metodologinis individualizmas, racionalumas, pirmenybių stabilumas ir rinkos pusiausvyra. Nurodomas šių metodologinių prielaidų turinys, pateikiama kritika ir kontrargumentai dėl jų trūkumų. Taip pat analizuojamos svarbesnės paradigmos tyrimų kryptys, tarp jų Čikagos teisės mokykla, Jeilio teisės mokykla ir institucionalistinė ekonominė teisės analizė. Konstatuojama paradigmos įvairovė ir tai, kad nėra konvencinio supratimo. Siūloma į ekonominę teisės analizę žvelgti kaip į labai įvairiapusį instrumentą tiek teisės doktrinoje, tiek praktikoje, panaudojant ekonomikos atstovų įdirbį ir mąstymo schemas teisės klausimams spręsti. ENEconomic Analysis of Law is a paradigm, which has not noted much attention in Lithuanian legal doctrine so far. This article is a pursue to fill in the existing gap, provide an impetus as well as framework for further researches. The article is focused on concept and methodology of the paradigm. The article analyses modern Economic Analysis of Law, namely – the methodological assumptions and fields (schools) of important research areas. It is stated that Economic Analysis of Law is basically based on methodological assumptions of neoclassical economics: methodological individualism, rationality, stable preferences and equilibrium. The content of aforementioned assunptions as well as critics and efforts to solve arising problems of them are discussed. Certain important schools of thought and (or) fields of researches are also identified. It is emphasised that Economic Analysis of Law cannot easily be divided into certain few schools, because it became a miscellaneous phenomenon nowadays. Nevertheless certain crucial approaches can be highlighted. Among those are positive thought of R. Posner and Chicago Law School, competing normative ideas of G. Calabresi of Yale Law School and the impact of institutional Economic Analysis of Law. Relevant trends in Economic Analysis of Law such as Public Choice, Behavioural Economic Analysis of Law and others are also discussed. It is argued that Economic Analysis of Law can be a very useful tool for both legal scholars and law practitioners as it allows insights into the same legal problems from a different (i.e. economic) angle – through the economic-based perception of the world subsistence.
