Interesų konflikto vadyba: nuo teorinio ir teisinio draudimo link praktinio realizavimo galimybių

LTStraipsnyje analizuojamos interesų konfliktų vadybos galimybės viešajame sektoriuje. Interesų konfliktas yra sena socealinė problema, kurios šaknys glūdi žmogaus egoistinėje prigimtyje. Interesų konfliktas būdingas tiek viešam, tiek privačiam sektoriui, atskiroms profesijoms, jo rezultatas šališkas ir neskraidrus sprendimų priėmimas, neteisingas ir šališkas pareigų atlikimas. Interesų konfliktas susijęs su vaidmenų konfliktu, kuriuos sukuria sudetingėjantis šiuolaikinis pasaulis, diktuojantis tam tikrą gyvenimo būdą, kuriame dažnai į pirmą planą yra keliami privatųs, o ne višieji tikslai. Interesų konfliktas yra artimas korupcijai, kuri paprastai yra siejama su didele finansine nauda, tuo tarpu interesų supainiojimas gali duoti ne tik materialinę naudą, bet ir būti susijęs su statuso pasikeitimais, naujais įsipareigojimais ir kt. Neišspręsto interesų konflikto rezultatas dažnai esti korumpuota veikla, piktnaudžiavimas pareigomis, blogas elgesys, neteisėti veikmai, smukusi reputacija, integralumo pažeidimas ir kt. Todel šalia supratimo apie viešų ir privačių interesų nesuderinamumą ne mažiau svarbi yra visapusiška interesų konflikto vadyba, kuri remtųsi aiškiai suformuluota politika. ENThe article analyses the management of interest conflicts in the public sector. It provides a definition of the conflict of interests and lists their types; it also explains its causes and consequences. Globalization processes have affected many countries in the 21st century. Individualism seems unbridled while collectivism has been unjustly devalued not only in post-communist countries, but also in the USA and other western countries. The conflict of interests is an old social problem stemming from the egotistic human nature. The conflict of interests occurs in both public and private sectors and in different professions; it results in biased and shady decision-making and unjust and biased performance of one’s duties. It is related to the conflict of roles caused by the complicated modern world that imposes a certain lifestyle where private interests often come before public interests. The conflict of interests is similar to corruption, which is usually related to a substantial financial profit, while the conflict of interests may not only yield a material profit, but it may also be related to a change in status, new responsibilities, etc. An unresolved conflict of interests often leads to corruption, authority abuse, bad behaviour, illegal actions, tarnished reputation, violation of integrity, etc. Therefore, the knowledge that public and private interests are incompatible is as important as the complex management of interest conflicts based on a clear policy. Preventative measures are extremely important in the management of interest conflicts.
