Aptariama bendroji požymio samprata, nusikalstamos veikos sudėties požymio panašumai ir atskyrimas nuo požymių, apibūdinančių nusikalstamą veiką, sudarančių baudžiamojo įstatymo straipsnio ar baudžiamosios teisės normos dalis, taip pat sistemiškai išskiriami veiksniai, labiausiai formuojantys ir lemiantys nusikalstamos veikos sudėties požymio turinį. Tarp tokių veiksnių minimi ir išsamiai aprašomi teisės technikos, formaliojo nullum crimen sine lege principo, teisės aiškinimo ir jo ribų reikalavimai. ENArticle reveals the conception of the constituent feature of the body of criminal act and identifies the main factors affecting it. The first part of the article contain an analysis of general conception of the feature, its legal and theoretical framework. Moreover there is analysed the ratio between the constituent features of the body of criminal act and the features of the article, the rule of law and the offence. The second part of the article assesses the influence which the legal technique makes to the constituent feature of the body of criminal act. There is also pointed out that the legal technique is very important for the classification of these features. In the third part of the article there are emphasized the formal principle of nullum crimen sine lege, the interpretation of law and its limits among the main factors which affect the content of the constituent feature of the body of criminal act. The article also answers the question what kind of role has the judicial interpretation to the content of strictly formal feature. After the identification of the key factors, which determine the conception of the constituent feature of the body of criminal act, as well as an evaluation of their mutual relationship, the article ends with the conclusion on the significance of these factors for the qualification of the criminal act.
