LTStraipsnyje nagrinėjama viena iš esminių ekstradicijos leistinumo taisyklių - non bis in idem, nustatanti, kad negali būti išduoti asmenys, patraukti baudžiamojon atsakomybėn už nusikaltimus, dėl kurių prašoma ekstradicijos. Autorius kelia abejonę non bis in idem taisyklės pagrįstumu ir argumentuoja šios taisyklės modifikavimo galimybes. Straipsnyje formuluojami teiginiai grindžiami nagrinėjamos taisyklės samprata skirtingos teisės tradicijos valstybėse, jos ir žmogaus teisių apsaugos poreikių sąsajų analize. ENArticle is devoted to the analysis of the rule of non bis in idem in extradition. The main attention is paid to the problem of the rejection of the rule. The author acknowledges that even though the rule of non bis in idem is considered as a basic precondition for extradition in the great majority of national and international legal instruments it still should attract criticism. While analyzing the rule of non bis in idem the author unveils the different concepts of it that have evolved in separate legal traditions. The main attention is paid to the question which term - offence or act - should be considered as the most suitable for a formulation of the rule in the regulation of extradition. As it is unveiled in the article, the formulation of the rule with a help of a term "offence" is mostly influenced by international legal considerations which should have no weight while solving the problems of extradition, i. e. taking into account only the scope of rights of the requested state. The conclusion empowers to negate possibilities of relinquishment of the rule. However the author stresses that in certain situations the rule should not preclude extradition when the requesting state guarantees that the penalty served in the requested or a third state will be taken into account while sentencing the extradited person.
