Valstybes vadovo statusas : teoriniai ir praktiniai klausimai

LTRespublikos Prezidentas pagal Lietuvos Respublikos Konstitucijos 77 straipsnio pirmąją dalį yra valstybės vadovas. Ką tai konkrečiai reiškia, Konstitucija nepaaiškina. Todėl, vertinant Respublikos Prezidento įgaliojimus ir Konstitucijoje nenumatytus veiksmus, pavyzdžiui, viešą nepasitikėjimą Ministru Pirmininku, reikšminga atskleisti žodžių „valstybės vadovas“ turinį. Sisteminis Konstitucijos 5 straipsnio ir 77 straipsnio aiškinimas suponuoja mintį, kad valstybės vadovas - tai asmuo, kuris formaliai yra valstybės priešakyje ir kaip visos valstybinės bendruomenės atstovas vykdo integruojančią veiklą pagal savo įgaliojimus, nepaneigdamas Seimo, Vyriausybės ir teismų galių dalyvauti vadovaujant valstybei. Šitaip Konstitucijos 77 straipsnio pirmojoje dalyje įtvirtinamas Respublikos Prezidento statuso pagrindas ar jo veiklos pagrindinis principas, kuris kitų Konstitucijos principų atžvilgiu gali būti vertinamas kaip fundamentalus įgaliojimas, papildantis Konstitucijos 84 straipsnyje pateiktą Respublikos Prezidento įgaliojimų sąrašą. Šiuo požiūriu Respublikos Prezidento mėginimą politiškai (t. y. žodine nepasitikėjimo išraiška) priversti atsistatydinti Ministrą Pirmininką legitimuoja valstybės vadovo rangas. ENThe President of the Republic of Lithuania is the head of the state as per Part 1 of Article 77 of the Constitution of the Republic of Lithuania. However, the Constitution does not specify this concept. Therefore, when evaluating the commission of the President of the Republic and actions unspecified in the Constitution, for example, President’s public distrust of the Prime Minister, it is necessary to reveal the content of the word combination “the head of the state”. Systemic interpretation of Article 5 and 77 of the Constitution implies that the head of the state is a person, who formally leads the country and, as the representative of the state community, implements integrating activities according to his or her mandate without diminishing the right of the Seimas, the Government and courts to participate in the governance of the state. This is the base of the status of the President of the Republic of Lithuania or the main principle of his or her activities specified in part 1 of Article 77 of the Constitution, which may be evaluated as a fundamental mandate supplementing the list of mandates of the President of the Republic of Lithuania specified in Article 84 of the Constitution. With this respect, the attempt of the President of the Republic of Lithuania to politically (i.e. verbal expression of distrust) force the Prime Minister to resign is legitimised by the rank of the head of the state.
