Vykdymo procesas Lietuvoje: esama padėtis ir reformavimo kryptys

LTVisuotinai žinoma dabar esanti vykdymo proceso faktinė ir teisinė padėtis, kai dėl vykdymo proceso trūkumų negali būti privalomai realizuojamos materialinės teisės normos. Tai diskredituoja pačią teisingumo idėją, kadangi suinteresuotas asmuo negali pasiekti, kad realiai būtų įvykdytas teismo sprendimas. Esančios teismo sprendimų vykdymo sistemos problemos nėra vien tik teisinės ir negali būti išspręstos tik teisinėmis priemonėmis. Jos glaudžiai susijusios su esama politine ir pirmiausia ekonomine valstybės padėtimi. Tačiau problemos, susijusios su vykdymo proceso teisiniais nesklandumais, turi būti sprendžiamos kuo skubiau. Straipsnyje nagrinėjamos esamos teismo sprendimų vykdymo sistemos problemos ir jų sprendimo galimybės naujajame Civilinio proceso kodekse. ENGenerally well known is now existing factual and legal standing of the execution process when because of the fault of the execution process rules of the substantive law cannot be obligatory realised. In such a way the very concept of justice is to be dishonoured, as the person concerned of a real court judgement. Existing problems of the system of execution of court judgements are not only legal problems and cannot be solved only by legal measures. They are closely related to the present political and, first of all, economic situation of the state. However, problems related to the legal problems of the execution process have to be solved as soon as possible. The existing problems of the execution system of judgements and possibilities of their solution in the new Code of the Civil Procedure are examined in the article. [Text from author]
