ENHistоricаlly, consumer related disputes were non-arbitrable due to the unequal bargaining powers of the parties; consumers were often presented as weaker parties. The aforementioned views have been revised since then and no longer hold in the modern and arbitration friendly legal systems. Pursuant to the legislation of Lithuania consumer related claims are inarbitrable. The said situation will change once the proposed amendments of the Law on Commercial Arbitration of the Republic of Lithuania are adopted. However, some safeguards have been established in national arbitration laws in order to protect consumers. The article discusses whether the aforementioned safeguards are reasonable. Moreover, the work makes some recommendations regarding the prospect of arbitrability of consumer related claims in Lithuania. [From the publication]
