Vietos savivaldos sistema Pirmojoje ir Antrojoje Lietuvos Respublikoje

LTNorint suprasti dabartinę Lietuvos savivaldos sistemą, svarbu žinoti, ką perėmėme iš pirmosios Respublikos laikų, kas toje sistemoje buvo sėkminga, kas ydinga, kaip klostėsi savivaldos kūrimas mūsų valstybėje. Šio straipsnio tikslas — apibendrinti lietuviškosios savivaldos patirtį, apžvelgiant teisinę bazę, išryškinti pagrindines reformas ir posūkius. Bandoma nustatyti pirmosios Lietuvos Respublikos ir dabartinės savivaldos sistemų skirtumus. Straipsnio pradžioje aiškinamasi, kaip buvo kuriama vietos savivaldos sistema ir kaip ji veikė pirmojoje Lietuvos Respublikoje, vėliau nagrinėjama tai, kas būdinga dabartinės savivaldos raidai, kokios svarbiausios reformos atliktos per du dvidešimtmečius. Straipsnio išvadose teigiama, kad, palyginus abiejų laikotarpių savivaldybių teisinį reglamentavimą, matyti, kad antrojoje Respublikoje per visą laikotarpį nuo 1990 m. savivaldos sistema daug kartų keista, priimta labai daug įstatymų, dažnai derintos ir kaitaliotos įvairios įstatymų nuostatos, o pirmojoje Respublikoje buvo tik pora reformų ir keli maži įstatymų pakeitimai. Taigi akivaizdus antrosios Respublikos savivaldybių teisinio reglamentavimo nestabilumas. Kuriant dabartinį savivaldos modelį buvo šiek tiek žvilgčiojama į ankstesnės Lietuvos savivaldybes: bandyta atkartoti valsčių ir apskričių sistemos elementus, viršaičio institutą, vėliau – seniūno (ir seniūnijos). Visgi paradoksalu tai, kad kai kurie pirmosios Respublikos savivaldos sistemos elementai (pavyzdžiui, teritorinis atstovavimas, rinkimų sistemos struktūra) atrodo pažangesni nei Lietuvoje egzistuojantys šiuo metu.Reikšminiai žodžiai: Antroji Lietuvos Respublika; Antroji Respublika (1990-2010); Pirmoji Lietuvos Respublika; Pirmoji Respublika (1918-1940); Rinkimų sistema; Vietos savivalda; Electoral system; First Lituanien Republic; First Republic (1918-1940); Local self-government; Second Lituanien Republic; Second Republic (1990-2010).

ENIn order to understand the current Lithuanian self-government system, we must know what we have taken over from the period of the first Republic, what was successful and faulty in that system, and how the formation of self-government developed in our state. The paper aims to summarise the experience of Lithuanian self-government, by giving an overview of the legal framework, and to highlight the key reforms and twists. It attempts to identify the differences between the self-government system of the first Republic of Lithuania and the current self-government system. The paper explores how the self-government system was created and how it functioned in the first Republic of Lithuania, and analyses what is characteristic of the development of the current self-government and what major reforms were conducted within two decades. The paper concludes that the comparison of the legal regulation of municipalities of both periods shows that the self-government system of the second Republic has undergone many changes during the entire period since 1990, a large number of laws have been adopted, various legal provisions have been often harmonised and amended, whereas in the first Republic there were a couple of reforms and several minor amendments to laws. The current self-government model has been created with regard to the municipalities of previous Lithuania: there have been attempts to reproduce the elements of the system of volosts and counties, the institution of the chief of a district, and subsequently the elder (and eldership). However, it is a paradox that certain elements of the self-government system of the first Republic (e.g. territorial representation, the structure of the electoral system) seem to be more advanced than those currently existing in Lithuania.
