ENIt is argued that the principle of proportionality in the jurisprudence of the European Court of Human Rights is used to establish a balance between an interference and its aim. In the context of negative obligations concerning Art. 8 of the Convention, proportionality is examined as one of the elements of the principle of "necessity in a democratic society", expressing a balance between a lawful and corresponding to a pressing social need interference on one side, and legitimate aim on the other side. In the context of positive obligations, proportionality is examined as "fair balance" between public interests and rights protected by Art. 8 of the Convention. In determining the proportionality of an interference, criteria describing the intensity of an interference (nature, length, less restrictive alternative) and its impact upon the rights guaranteed by the Convention ("the very essence" doctrine, individual circumstances of the applicant) are employed. Then, taking into account circumstances justifying an interference it is determined whether a balance was struck between an interference and its aim. [From the publication]
