Įrodymų leistinumo samprata Lietuvos baudžiamojo proceso teisėje

LTStraipsnyje siekiama atskleisti įrodymų leistinumo sampratą iki 2002 m. BPK įsigaliojimo, mokymo apie įrodymų leistinumą reikšmę po 2002 m. BPK įsigaliojimo ir dabar doktrinoje ir teismų praktikoje vartojamos įrodymų leistinumo sąvokos turinį ir prasmę. Atlikta analizė leidžia teigti, kad iki 2002 m. Lietuvos Respublikos baudžiamojo proceso kodekso įsigaliojimo vyravęs mokymas apie įrodymų leistinumą po šio kodekso įsigaliojimo neteko procesinės prasmės, o vienintelis aktualus įrodymų leistinumui priskiriamas dalykas yra neteisėtai gautų duomenų pripažinimo įrodymais baudžiamajame procese problematika. ENThe article seeks to reveal the concept of admissibility of evidence before the adoption of the Criminal Procedure Code in 2002, the significance of teaching about the admissibility of evidence after the adoption of the Criminal Procedure Code in 2002 and the content and meaning of the concept of admissibility of evidence used in the doctrine and the court practice. The performed analysis allows stating that the teaching about the admissibility of evidence prevailing before the adoption of the Criminal Procedure Code of the Republic of Lithuania in 2002 lost its procedural sense after the adoption of the code, and the only relevant aspect of the admissibility of evidence is the issue of recognition of illegally obtained data as evidence in the criminal procedure.
