Teisminė mediacija Lietuvoje. Quo vadis?

LTNuo „Bandomojo teisminės mediacijos projekto“ pradžios praėjus daugiau kaip ketveriems metams, yra įdomu ir naudinga pažvelgti į teisminės mediacijos projekto Lietuvoje rezultatus bei problemas, įvertinti teisminės mediacijos projekto Lietuvoje įgyvendinimo veiksmingumą. Atsižvelgiant į tai, šiuo straipsniu siekiama įvertinti teisminės mediacijos projekto Lietuvoje rezultatus, nustatyti projekto vykdymo metu iškilusias problemas ir pasiūlyti jų sprendimo būdus. Pirmoje straipsnio dalyje yra nagrinėjamos Bandomojo teisminės mediacijos projekto prielaidos, antroje dalyje – teisinis pagrindas, trečioji straipsnio dalis yra skirta identifikuoti teisminį mediacijos Lietuvoje modelį, ketvirtoji ir penktoji – Bandomojo teisminės mediacijos projekto rezultatams ir problematikai. ENMore than four years have passed since the beginning of the Pilot Court Mediation Project in Lithuania. It may prove useful to examine the results and problems of the project and evaluate its effectiveness. The present article assesses the results of the project, attempts to identify problems encountered and propose possible solutions. The first part of the article analyses the preconditions for the project. The second part of the paper deals with the legal grounds. The third part of the article focuses on the identification of the model of court mediation applied in Lithuania, while the fourth and the fifth parts are devoted to the results and problematic issues in the project.
