Atstovų nesutikimo gydyti nepilnametį pacientą teisiniai ypatumai

LTStraipsnio tikslas – analizuoti teisėtų atstovų nesutikimo gydyti nepilnameti pacientą iki 16 metų probleminius aspektus teisės teorijos ir praktikos atžvilgiu. Straipsnyje pabrėžiama, kad nors Lietuvoje tėvai ir kiti teisėti atstovai turi teisę atsisakyti gydyti vaiką iki 16 metų amžiaus, gydytojui išlieka pareiga vertinti tokį pasirinkimą ir, priimant sprendimą dėl negydymo, įsitikinti, ar gydymo neteikimas atitinka vaiko interesus. Pastaruosius galima apibrėžti kaip vaikui palankias sąlygas, kurios jam užtikrina kiek įmanoma visapusiškesnę ir darnesnę fizinę bei psichinę raidą, leidžia pasirengti savarankiškai gyventi visuomenėje (negalios atveju – pasiekti maksimalų savarankiškumo laipsnį). Dėl šių ypatumų vaiko interesai yra sietini tik su priimamų sprendimų teigiama įtaka vaiko gyvenimo kokybei, tiek sprendimo priėmimo metu, tiek ir tolesniame gyvenime. Straipsnyje konstatuojama, kad teisės sistema nesukuria prielaidų manyti, kad esama ar numatoma bloga gyvenimo kokybė gali būti suprantama kaip vaiko interesas būti negydomam, kai toks gydymas yra indikuotinas bei veiksmingas. Kaip ir bet kuris kitas asmuo, vaikas turi teisę gyventi ir pirminį interesą išgyventi, nes šis interesas yra visų kitų jo interesų, ir, savaime aišku, jo teisių, pamatas. ENTreatment withdrawal or treatment withholding are very delicate and ethically sensitive issues when we are dealing with minor patients before the age of consent (until 16 year old) and the expressed orders of their legal representatives, because withdrawing and withholding treatment is closely interconnected with basic values defended by the society and, undoubtedly, by law. The main goal of this article is to analyze different aspects of treatment withdrawal and treatment withholding for the patients before the age of consent, which may be problematic from the point of view of legal practice and theory. The article states, that Lithuanian law creates a possibility for parents ant other legal representatives to withhold or withdraw treatment, when a patient has not reached the age of consent. However, this legal representatives' decision is possible only in case it corresponds with the interests of the child. So, the concept of the interests of a child has a central role in a decision making procedure ant may override expressed orders of legal representatives.The article acknowledges that the interests of a child are defined thought various conditions that provide the best possibilities for the development of physical, psychical and social well-being of a child. Therefore the interests of a child are connected with decisions and actions, which positively influence the quality of life during the process of decision making and in the future of a child. The article summarizes that legal system does not create prerequisites to suppose that bad quality of life might create an interest do not receive treatment when treatment is medically indicated.
