Lygtinis paleidimas iš pataisos įstaigų: teisiniai ir socialiniai aspektai : disertacija

LTDisertacijoje kompleksiškai teisiniu lyginamuoju rakursu nagrinėjamas vienas iš bausmių vykdymo teisės institutų – lygtinis paleidimas iš pataisos įstaigų. Disertacija apima visapusišką lygtinio paleidimo tyrimą nuo jo teorinio iki praktinio realizavimo pažinimo. Pažymėtina, kad lygtinio paleidimo samprata Lietuvos moksle nėra atskleista, o šio instituto taikymo ir turinio teisinis reguliavimas ne visuomet užtikrina sėkmingą nuteistųjų resocializaciją. Taigi, disertaciniame tyrime modeliuojama lygtinio paleidimo teisinė sąvoka, taip pat jame pateikiama nauja skyrimo pagrindų ir vykdymo tvarkos, pagrįstos nuteistųjų pakartotinio nusikalstamo elgesio rizikos, kriminogeninių veiksnių (poreikių) vertinimu ir efektyvia nuteistųjų resocializacija, koncepcija. Šiame mokslo darbe nagrinėjama lygtinio paleidimo sąvokų ir rūšių įvairovė, jam būdingi elementai, identifikuojama vieta teisės sistemoje, nagrinėjama raida, analizuojama institucinė lygtinio paleidimo taikymo sistema, jo skyrimo apimtis ir pagrindai, o taip pat kriterijų vertinimo metodai, nuteistųjų, lygtinai paleistų iš pataisos įstaigų, priežiūra (socialinė reabilitacija ir kontrolė, elektroninis monitoringas), jų teisinė padėtis, tiriami šiuolaikiniai jų priežiūros modeliai, ir galiausia – teisinių santykių, susijusių su lygtiniu paleidimu, pasibaigimo ypatumai bei ankstesnis nuteistųjų atleidimas nuo lygtinio paleidimo priežiūros. Disertaciniame darbe taip pat išskiriami lygtinio paleidimo požymiai ir jis atribojamas nuo panašaus baudžiamosios teisės instituto – lygtinio atleidimo nuo bausmės prieš terminą.

ENThe thesis, in complex legal comparative terms, analyses one of the penal institutes – probationary release from correctional facilities. The thesis covers a thorough analysis of probationary release from its theoretical to its practical implementation perspective. It should be noted that the concept of probationary release in Lithuanian science has not been revealed yet, and the legal regulation of content and application of the institute does not always ensure successful re-socialization of convicted persons. Therefore the thesis provides a model of the legal concept of probationary release and a new conception of the basis for and the procedure of implementation of probationary release, based on estimation of the risk of a repeated criminal behaviour by the convicts, criminal factors (needs) and an efficient re-socialization of convicts. The study analyzes the diversity of types and concepts, as well as the characteristic elements, examines the development and identifies the place of probationary release in the legal system, analyzes the institutional system of application, the grounds and scope of probationary release, as well as the methods for evaluation of the criteria, supervision of the convicts on probationary release from correctional institutions (social rehabilitation and control, electronic monitoring), the legal status of the convicts, examines the modern models for supervision of the convicts and, finally – the particularities of ending of the legal relations, pertaining to probationary release and the advanced release of the convicts from the supervision. The thesis also distinguishes the traits of probationary release by separating it from another similar institute of the criminal law – exemption from the amenability and release from the correctional institution prior to the time for release.
