Alternatyvus civilinių ginčų sprendimas : disertacija

LTMokslo darbo tyrimo objektas – alternatyvus civilinių ginčų sprendimas, jo samprata ir pagrindiniai bruožai, kilmė, raida, paskirtis, alternatyvaus civilinių ginčų sprendimo procedūros ir jų ypatumai. Disertacijoje siekiama kompleksiškai ištirti ir įvertinti alternatyvų teismui civilinių ginčų sprendimą, pateikti pasiūlymų ir rekomendacijų dėl jo teisinio reglamentavimo ir praktinio taikymo Lietuvoje. Disertaciniame darbe atlikto mokslinio tyrimo rezultatai gali būti panaudoti vystant ir plėtojant Lietuvoje alternatyvaus teismui civilinių ginčų sprendimo koncepciją, formuojant mūsų šalies poreikius ir teisės sistemą atitinkantį alternatyvaus ginčų sprendimo modelį. Šiame darbe autorės ištirti klausimai yra svarbūs ir lyginamosios teisėtyros požiūriu. Disertacinio darbo išvados gali būti naudingos gerinant Lietuvoje egzistuojančių alternatyvaus ginčų sprendimo procedūrų teisinį reglamentavimą, taip pat tobulinant LR Civilinio kodekso ir LR Civilinio proceso kodekso normas ir kitus teisės aktus, reguliuojančius civilinių ginčų sprendimą ne civilinio proceso tvarka Lietuvoje.

ENThe object of the study is the alternative resolution of civil disputes, its concept and the main characteristics, origins, development, purpose, the procedures of alternative resolution of civil disputes and their particularities . The thesis aims at complex examination and evaluation of the resolution of civil disputes, alternative to the court of law, provision of proposals and recommendations with regard to legal regulation of such resolution and its application in Lithuania. The results of the scientific research, performed in the thesis can be used in development of the concept of the resolution of civil disputes, alternative to the court of law in Lithuania, in formation of the needs of the country and the model of alternative resolution of disputes, compliant to the legal system. The issues, examined by the author in the study are also important in terms of comparative jurisprudence. The conclusions of the thesis can be useful for the purpose of improvement of the legal regulation of alternative dispute resolution procedures, existing in Lithuania, as well as in improving the norms of the Civil Code of the Republic of Lithuania and the Code of Civil Proceedings of the Republic of Lithuania and other legal acts, regulating resolution of civil disputes not according to the procedure of the civil process.
