LTStraipsnyje analizuojamos seksualinio priekabiavimo, kaip baudžiamojo nusižengimo, taikymo Lietuvoje problemos ir pagrindiniai veiksniai, lemiantys prastą normos funkcionavimą. Daugiausia dėmesio kreipiama formaliajai seksualinio priekabiavimo, kaip baudžiamojo nusižengimo, sudėties probleminių požymių analizei, taip pat išskiriami esminiai kriminalizavimo kriterijai, kurių seksualinio priekabiavimo norma visiškai arba iš dalies neatitinka. ENThe article focuses on the formal analysis of the most problematical features of the criminal rule of sexual harassment. In the first part of the article the author shortly talks about the sources of the legal amenability of sexual harassment in the Republic of Lithuania. The second part concretizes the object of the article. It is about the most problematical aspects of the article 152 ("Sexual harassment") of Lithuanian Criminal Code. The most negotiable features are compared with the regulation which exists in the United States of America. In the third part of the article the author talks about the reasons why criminal rule of sexual harassment is not practiced in the Repulic of Lithuania. The author divides all reasons into a few groups: technical-legal reasons and factual reasons. The results of the research show that the main reason is very difficult averment of subjective features of sexual harassment. Moreover there are emphasized the criminalization criterions, which the rule of sexual harassment does not pass. All findings of the research are based on the results of the survey which was given to the prosecutors and the criminal law students. [From the publication]
