Sutarties dėl su prekyba susijusių intelektinės nuosavybės apsaugos aspektų istorinės priėmimo aplinkybės ir reikšmė tarptautiniam nesąžiningos konkurencijos teisės vienodinimui. ENArticle examines historical development of the Paris Convention, the WIPO Model Provisions, also the TRIPS Agreement, and their significance to international harmonisation of unfair competition law. The research points out that initially the Paris Convention contained no provisions against unfair competition law. Its currently valid Article lObis is a result of the multiple revisions of the Convention that took place between 1900 and 1958. The flexible general clause and the three examples of unfair competition acts found in this Article were a model for development of unfair competition laws for many countries in the first half of the 20th century. However, they do not meet the needs of today. The TRIPS Agreement touches upon unfair competetion issues only insofar this relates to protection of the geographic indications and undisclosed information. Absence of more general regulation of unfair competition in this Agreement is justly seen as a lost opportunity to remedy deficiencies of Article lObis of the Paris Convention and create international rules corresponding to modern tendencies in this field. The worldwide survey of status quo of unfair competition laws served as a basis for drafting the WIPO's Model Provisions. They state they aim to implement obligations mandated by Article lObis of the Paris Convention, however, in comparison with the latter, they contain some conceptual novelties. Though the Model Provisions are not legally binding, their effect in practice equal to that of the recommendations. In one of the conclusions following the Article it is observed that international harmonisation of unfair competition law has not been as successfull as of the traditional areas of intellectual property law so far, also that the experience of the preceding harmonisation docs not allow to expect the situation will change in the nearest future.
