Aktualūs vaiko išlaikymo dydžio nustatymo klausimai

LTStraipsnio tikslas – teisės doktrinos ir teismų praktikos analizės pagalba pasistengti atskleisti aktualius klausimus, susijusius su vaiko išlaikymo dydžio nustatymu bei aplinkybėmis, determinuojančiomis tėvų pareigos išlaikyti nepilnamečius vaikus vykdymo tinkamumą. Straipsnyje apžvelgiamos pasaulyje labiausiai paplitusios vaiko išlaikymo dydžio nustatymo sistemos, identifikuojami jų privalumai ir trūkumai. Pažymima, kad Lietuvoje ilgą laiką taikytą procentinės pajamų dalies sistemą pakeitusi poreikių ir galimybių balanso sistema yra sąlygota pasikeitusios ekonominės ir socialinės visuomenės gyvenimo tikrovės, paneigusios visų visuomenės narių ekonominę lygiavą, vienodą gyvenimo kokybę, garantuotą darbo užmokestį ir kt. Analizuojami pagrindiniai vaiko išlaikymo dydžio nustatymo kriterijai: vaiko poreikiai ir abiejų tėvų materialinė padėtis. Konstatuojama, kad Lietuvos teisinėje sistemoje, nustatant vaiko išlaikymo dydį, iki šiol remiamasi realių tėvų pajamų nustatymo metodu, kai tuo tarpu kitose valstybėse vaiko interesų apsauga iššaukia poreikį taikyti fiktyvaus pajamų įvertinimo metodą. ENThe purpose of the article is to examine the relevant issue of establishing the amount of child support and conditions determining parents’ duty to support the child, by analysing the legal doctrine and jurisprudence. The article examines the most widespread systems of establishing the amount of child support in the world, identifying their strengths and weaknesses. It notes the reason why the long-established system of applying the percentage share of income used in Lithuania was replaced by the needs and possibilities balance system: this change was caused by the overall change in economic and social reality in the country: today‘s society denies the economic equality of all people, the same quality of life, and guaranteed work pay, etc. The article analyses the main criteria for determining the amount of child support, i.e. the needs of the child and the material status of both parents. It states that the Lithuanian legal system establishes the amount of child support on the basis of the actual income gained by parents, whereas the other countries see the need to apply the method of fictitious income in their pursuance of protection of children rights. The article describes the advantages of the latter method, trying to justify the reasons for its application in the Lithuanian jurisprudence.
