Visuomenės poreikis kaip nekilnojamojo turto išpirkimo sąlyga

LTStraipsnyje analizuojama viena iš pagrindinių po nepriklausomos Lietuvos valstybės atkūrimo išlikusio nekilnojamojo turto išpirkimo iš asmenų, turinčių teisę į nuosavybės teisių į šį turtą atkūrimą, sąlygų - visuomenės poreikis. Autorė siekia pagrįsti poziciją, kad šiai išlikusio nekilnojamojo turto išpirkimo sąlygai nustatyti taikytini kriterijai, įtvirtinti Lietuvos Respublikos Konstitucijos 23 straipsnio 3 dalyje, reglamentuojančioje nuosavybės paėmimo, arba nusavinimo, visuomenės poreikiams konstitucines garantijas. ENThe article deals with the social need as one of the primary conditions to redempt the real property from the persons who have the right to the restoration of the ownership rights, after the Republic of Lithuania has gained its' independence. The author seeks to justify a position that criteria defined by Part 3 of Article 23 of the Constitution of the Republic of Lithuania providing for the constitutional guarantees of the expropriation of property due to the social needs, are also applied to determination of the above mentioned condition of redemption of the existing real property.
