Lietuvos ekologinės teisės sistemos formavimasis

LTPaskutiniajame dešimtmetyje Europoje įvykę gamtiniai, socialiniai bei ekonominiai pokyčiai sąlygojo padidėjusius visuomenės ekologinio saugumo poreikius. Minėtų poreikių didėjimas savo ruožtu paspartino aplinkosaugos problemų sprendimo teisinio mechanizmo, tuo pačiu ir teisės doktrinos, vystymąsi. Pakito ir tarptautinis, ir Lietuvos aplinkosaugos teisinis reguliavimas. Šio straipsnio tyrimo objektas - Lietuvos ekologinės teisės sistema. Straipsnyje siekiama nustatyti ekologinės teisės doktrinos būklę, jos ir kitų teisinio reguliavimo sudėtinių dalių: norminės bei praktinės, sąsajas su ja. Be to, aptariama Europos Sąjungos aplinkos teisės reikšmė formuojant nacionalinę Lietuvos ekologinės teisės normų ir jų įgyvendinimo sistemą. Straipsnį sudaro įžanga, trys dalys bei išvados. Pirmojoje dalyje pateikta Lietuvos ekologinės teisės normų ir jų praktinio įgyvendinimo sistemos kūrimo apžvalga. Antrojoje įvertinta Lietuvos ekologinės teisės doktrinos būklė. Trečioji straipsnio dalis skirta apžvelgti Europos Sąjungos aplinkos teisės įtaką Lietuvos nacionalinės ekologinės teisės sistemai. Pastaroji dalis apima Europos Sąjungos aplinkos teisės, kaip Lietuvos ekologinės teisės norminį bei praktinį lygmenį formuojančio veiksnio, reikšmės nustatymą. Išvadose nurodomi keistini bei tobulintini Lietuvos ekologinės teisės doktrinos bruožai, Lietuvos ekologinės teisės sistemos formavimosi tendencijos. Mokslinio tyrimo metodų pagalba siekiama įvertinti Lietuvos ekologinės teisės doktriną bei visos ekologinės teisės sistemos raidą, nustatyti pagrindinius bendrus Europos Sąjungos aplinkos teisės įtakos nacionalinei ekologinei teisei bei jos įgyvendinimo sistemai bruožus. ENThe natural, social and economic changes accomplished in the nineties in Europe conditioned the enlarged ecological safety needs of society. The growth of the above-mentioned needs, in turn, accelerated the development of solution of the environmental problems mechanism and also the development of law doctrine. Especially marked changes are noticed both in international and in the Lithuanian environmental legal regulation. The object of investigation of this article is the system of Lithuanian Ecological law. The author is trying to ascertain the condition of the doctrine of Ecological law and also its and other constituents of legal regulation: standard and practical links with it. Also the influence of Environmental law of European union upon the development of norms and their realization system of Lithuanian Ecological law is being discussed. The article consists of preface, three parts and conclusions. In the first part there is supplied the review of Lithuanian Ecological law rules and the creation of practical implementation of rules. In the second part there is estimating the condition of the doctrine of Lithuanian Ecological law. The third part of article is intended to reveal the influence of Environmental law of European Union to the Lithuanian national Ecological law system. The last-mentioned part involve the Environmental law of European Union as the factor which is forming the standard and practical level of Lithuanian Ecological law establishment of importance.In the conclusions there are indicated changeable and perfectible features of the doctrine of Lithuanian Ecological law, the tendencies prevailing in the science of Ecological law. With the help of scientific inquiry methods the author is trying to evaluate the doctrine of Lithuanian ecological law and the development of whole ecological law system, to ascertain the main common features of the influence of Environmental law of European Union to the national Ecological law and its realization system.
