Paciento teisių ir pareigų teisinio reglamentavimo Lietuvoje problematika ir raidos tendencijos

LTStraipsnio tikslas įvertinti paciento teisinės apsaugos lygį Lietuvoje, aptarti paciento teisių ir pareigų reglamentavimo raidą ir tendencijas, išanalizuoti paciento teisių reglamentavimo trūkumus ir pateikti siūlymus dėl parengto LR pacientų teisių ir žalos sveikatai atlyginimo įstatymo pakeitimo įstatymo projekto. Straipsnyje apžvelgiamas paciento, kaip sveikatos priežiūros paslaugų teikimo teisinio santykio dalyvio, teisių ir pareigų reglamentavimas atkūrus Lietuvos Respublikos nepriklausomybę. Straipsnyje analizuojamos besikeičiančios ir aktualiausios paciento teisės (teisė į sveikatos priežiūros prieinamumą, teisė skųstis), pacientų pareigos teikiant jam asmens sveikatos priežiūrą, jų turinys ir raida, vertinama paciento teises ir pareigas reglamentuojančių įstatymų reikšmė bei svarba, paciento teisių ir pareigų santykis su kitais teisės institutais, sveikatos teisėje vyraujančiomis koncepcijomis bei analizuojama teismų praktika šiais klausimais. Ypač daug dėmesio skiriama paciento teisių ir pareigų reglamentavimo pokyčių analizei ir tendencijų vertinimui. ENThe article aims at evaluating the level of legal protection of a patient in Lithuania, discussing the development and trends of regulation of the rights and responsibilities of the patient, analyzing the deficiencies of regulation of the patient’s rights and providing the suggestions regarding the prepared draft of the Law on the Amending of the Law on Patient’s Rights and Compensation for Damage to Patient’s Health of the Republic of Lithuania. The article provides an overview of the regulation of the rights and responsibilities of a patient as a participant of the legal relations in the process of provision of heath care services upon the reinstatement of the independence of the Republic of Lithuania. The article analyzes the changing and the most relevant rights of the patient (i. e. the right to receive health care services and the right to file complaints), the patients’ responsibilities when receiving the health care services, the content and development of the services, evaluates the significance of the laws, regulating the patient’s rights and responsibilities, the interrelation of the patient’s rights and responsibilities with other legal institutes, the concepts of the health law and analyzes the court practice in regard to the issues. Special attention is dedicated to the analysis of the changes in the regulation of the patient’s rights and responsibilities and evaluation of trends.
