Draudimo veiklos priežiūros teisinio reguliavimo raida atkūrus Lietuvos Respublikos nepriklausomybę (1990-2007 m.)

LTŠiuolaikinėje visuomenėje asmenų interesų, kylančių iš draudimo teisinių santykių, apsaugos klausimas yra itin aktualus. Lietuvos Respublikoje kiekvienam asmeniui yra užtikrinta teisė pažeistus interesus ginti teisme. Asmenų interesus, pažeistus vykdant draudimo veiklą, valstybė gina ir vykdydama administracinės priežiūros funkciją. Lietuvos Respublikoje draudimo veiklos priežiūrą atlieka Lietuvos Respublikos draudimo priežiūros komisija, kurios pagrindinis tikslas yra užtikrinti ne tik draudėjų, apdraustųjų, naudos gavėjų, nukentėjusių trečiųjų asmenų interesų ir teisių apsaugą, bet ir pačios draudimo sistemos patikimumą, veiksmingumą, saugumą ir stabilumą. Draudimo veiklos ir jos priežiūros teisinis reguliavimas Lietuvoje Respublikoje visą nepriklausomos valstybės laikotarpį smarkiai kito. Nebuvo išvengta teisinio reguliavimo spragų, todėl vykdoma priežiūra nebuvo pakankamai veiksminga ir ne visada pasiekdavo jai keliamus tikslus. Draudimo veiklos priežiūros teisinio reguliavimo klausimai bei kylančios problemos ir šiuo metu yra aktuali bei mažai teisės mokslininkų nagrinėta tema. Šiame straipsnyje bus kritiškai įvertinta draudimo veiklos priežiūros reguliavimo raida Lietuvos Respublikoje nuo 1990 m. iki 2007 m. bei pateikti pasiūlymai dėl esamo teisinio reguliavimo tobulinimo. ENThe issue of protection of persons’ interests, arising from the legal relations, pertaining to insurance is especially relevant in the modern society. In the Republic of Lithuania the right to protect one’s violated interests in the court of law is ensured to each and every person. The state protects the interests of persons, violated when executing insurance activities by performing the function of administrative supervision. In the Republic of Lithuania the supervision of insurance activities is performed by the Insurance Supervisory Commission of the Republic of Lithuania, whose main objective is to ensure not only the protection of the rights and interests of insurers, the insured persons, the beneficiaries and aggrieved third parties, but also the reliability, efficiency, security and stability of the insurance system itself. Legal regulation of insurance activities and its supervision in the Republic of Lithuania was constantly changing during the entire period of the independent state. No gaps in legal regulation were avoided therefore the supervision was not sufficiently efficient and not always reached its objectives. The issues of legal regulation of supervision of insurance activities and the arising problems still remain a relevant subject, little examined by law scientists. The article provides a critical evaluation of the development of regulation of supervision of insurance activities in the Republic of Lithuania from 1990 to 2007 and presents suggestions regarding the improvement of the existing legal regulation.
