Teisės gauti paslaugas, įgalinančias asmenį su negalia gyventi savarankiškai, užtikrinimas

LTLietuvos Respublika 2010 m. yra ratifikavusi JT Neįgaliųjų teisių konvenciją, 2012 m. parengė Pirminę ataskaitą dėl Konvencijos įgyvendinimo JT Neįgaliųjų teisių komitetui. 2016 m. Komitetas apsvarstė pateiktą ataskaitą ir pateikė savo rekomendacijas dėl tolesnio Konvencijos įgyvendinimo Lietuvoje. Šios rekomendacijos tapo Lietuvos neįgaliųjų socialinės integracijos į visuomenę politikos įgyvendinimo gairėmis. Straipsnyje siekiama įvertinti ar Lietuvoje asmenims su negalia tinkamai užtikrinamos galimybės gauti paslaugas, įgalinančias juos gyventi bendruomenėje savarankiškai. Tuo tikslu aptariami neįgalumo sampratos teoriniai ir teisiniai aspektai, negalią turinčio asmens teisinio statuso ypatumai Lietuvoje, analizuojamos teisės į socialinių paslaugų gavimą ir į aplinkos (fizinės ir transporto) prieinamumą užtikrinimas. Straipsnyje daroma išvada, kad neįgaliųjų socialinės integracijos politika Lietuvoje keičiasi nuo šalpos ir palaikymo link pačių asmenų su negalia gebėjimo integruotis į socialinį gyvenimą. Priimti neįgaliųjų lygiateisiškumą įtvirtinantys teisės aktai vertinami kaip pažangūs. Tačiau asmenų su negalia integracija nepakankamai užtikrina galimybes gyventi savarankiškai bendruomenėje ir gauti individualias paslaugas pagal poreikius, vis dar pastebima visuomenės segregacinė elgsena neįgaliųjų atžvilgiu, susiduriama su neįgalių asmenų teisių įgyvendinimo sunkumais. Paslaugų plėtra vykdoma neturint patikimų duomenų ir yra nepakankama, socialinės paslaugos planuojamos ir teikiamos kompleksiškai neįvertinus individualių poreikių. ENRepublic of Lithuania having ratified the UN Convention on the Rights of Persons with Disabilities in 2010, prepared the Initial Report on the Implementation of the Convention for the UN Committee on the Rights of Persons with Disabilities in 2012. In 2016 The Committee considered the submitted report and presented its recommendations regarding the further implementation of the Convention in Lithuania. These recommendations became the guidelines for the implementation of the policy of social integration of the people with disabilities into society in Lithuania. The aim of the article is to assess whether persons with disabilities in Lithuania are adequately provided with opportunities to receive services that enable them to live independently in the community. For that purpose, the article discusses theoretical and legal aspects of the concept of disability, the peculiarities of the legal status of a person with a disability in Lithuania, and analyzes the right to receive social services and the right to access the environment (physical and transport). The article concludes that the policy of social integration of the people with disability in Lithuania is changing from aid and support towards the ability of this social group to integrate into social life. Adopted legal acts consolidating the equality of the persons with disability are considered progressive.However, the integration of this social group does not sufficiently ensure opportunities to live independently in the community and receive individual services according to needs, the society's segregation behavior towards the people with disability is still noticeable, difficulties are encountered in the implementation of the rights of these persons. The development of services is carried out without reliable data and is insufficient, social services are planned and provided without comprehensive assessment of individual needs.
