Paciento šeimos narių asmens duomenų apsauga

LTStraipsnyje nagrinėjamos paciento šeimos narių asmens duomenų apsaugos problemos. Šio tyrimo kontekste paciento šeimos nariais laikytini tiek asmenys pagal teisinį giminystės ryšių aiškinimą, tiek ir asmenys, kuriuos giminystės ryšiai sieja pagal bendrą protėvį, kadangi esminis šių asmenų asmens duomenų tvarkymo tikslas – išsiaiškinti, nustatyti ar patvirtinti tam tikrą pacientui ir jo sveikatai reikšmingą informaciją. Straipsnyje aptariami „tylinčiosios šalies“ duomenys – asmens duomenys, susiję su duomenų subjektu, kuris nėra konkrečios paslaugos vartotojas, tačiau jo asmens duomenis šis paslaugos teikėjas tvarko, kad galėtų tinkamai suteikti paslaugą konkrečiam paslaugos vartotojui (pacientui). Paciento šeimos narių asmens duomenų tvarkymui neretai taikomi Bendrajame asmens duomenų apsaugos reglamente nustatyti specialių kategorijų asmens duomenų (sveikatos duomenų) tvarkymo reikalavimai, kurių išskirtinumas tas, kad vien tik reglamente numatytų duomenų tvarkymo sąlygų tinkamo įgyvendinimo nepakanka pagrįsti teisėtą šių duomenų tvarkymą ir būtina, kad toks tvarkymas taip pat atitiktų ir būtų tinkamai suderintas bent su viena reglamente nustatyta draudimo tvarkyti specialių kategorijų asmens duomenis išimtimi. Kai kurių paciento šeimos narių, kaip duomenų subjektų, teisės asmens duomenų apsaugos srityje yra gana apribotos ar net apskritai neįgyvendinamos, o derinant pagrindines žmogaus teises iš esmės pirmumas teikiamas paciento sveikatos interesų apsaugai, t. y. objektyviai pateisinamas paciento šeimos nario teisės į privatumą ir asmens duomenų apsaugą suvaržymas. ENThis article examines the issue of protecting the personal data of patients’ family members. In the context of this research, both persons according to the legal interpretation of family relations and persons who are related by kinship ties based on a common ancestor should be considered to be family members of a patient, since the essential purpose of processing the personal data of these persons is to find out, determine or confirm certain information relevant to the patient and their health. The article discusses silent party data – that is, personal data that relates to a data subject who is not a user of a specific service, but whose personal data is processed by this service provider in order to properly provide a service to a specific service user (patient). The processing of the personal data of a patient’s family members is often subject to the requirements for the processing of special categories of personal data (health data) set out in the General Regulation on the Protection of Personal Data, the uniqueness of which is manifested in the fact that the proper implementation of the data processing conditions provided for in the regulation alone is not sufficient to justify the legal processing of this data. It is also necessary that such processing corresponds and is properly coordinated with at least one exception to the ban on processing special categories of personal data established in the regulation. Some of the rights of the patients’ family members as data subjects in the area of personal data protection are sufficiently limited or even not implemented at all. When combining basic human rights, priority is essentially given to the protection of the patient’s health interests – that is, the constraint of the rights of the patient’s family members to the protection of privacy and personal data is justified.
